Need urgent help. My mothers visit visa rejected.

Hi all,

Need immediate help pls!!

My mother's visit visa has been refused. The two reason being given is ties in India and that she won't go back. She had clearly stated she's married for 40 years and has a joint family where she stays with her husband, son, daughter in law and two kids. Also that it's the first time she ll be travelling without my father..

The reason of applying visit visa was my pregnancy and she had even shown return tickets and a duration of one month stay during my delivery in April. She had mentioned in cover letter there is no one else to assist me during my delivery.

Can anyone pls suggest if applying through PHAC now will help. I really need her to be here as we don't have any body else to help me during my delivery.

Helping the host (you) for delivery is considered work. Couldn't you hire someone locally to do the job?

- What was the evidence that she submitted to show her proof of ties?
- How much did she show for proof of funds to support her trip?
- Does the have previous travel to countries requiring visas such as the US and UK?

1. As evidence she showed she's married for 45 yrs and stays in a joint family of husband son daughter in law and 2 grandsons.

2. She's never worked as she's a housewife. So we showed my father as the financial sponsor for all travel related expenses and also my acc as a second sponsor for bearing all costs in Canada. We showed a very good ITR of my father with a turn over of more than 1.5 crores annually.

3. She has never been out of the country. It's the first time she would be doing so for me. That's the sad part. She was very scared to do so but still she was doing it for me

But in the other threads, you mentioned that your status in Canada would expire in April? Can't you tell her to apply after you got your status extended? Also, since your father is not traveling, she needs her own fund for all travel related expenses.

My visa expires in April 2022. And my delivery is between 15th to 18th April. Tats the main reason we had applied in Feb for her.

it happened to me as well. I have no travel history its my first time, and our bank accounts in lebanon are no longer accessible and i need to prove a financial statement even though my host did. But it wasn’t enough.
I got a refusal too.
I dont know what to do

PHAC is not to circumvent being approved for a visitor visa. It is for urgent travel. Your mother can re-apply if she can strengthen her profile and address the reasons. Did you issue an invitation letter stating your were pregnant and needed help? Did it come across as working? Also your visa expires at the same time as your birth.

For a PHAC, your mother needs to request an exemption online if:

• She needs to leave your place of quarantine for compassionate reasons
• She will quarantine where she will support, care or have the funeral or end-of-life ceremony

I have a 2 yr old son so the main reason mentioned was to take care of him while I am hospitalized as it is a csection that I will be having so it needs atleast 3 to 4 days hospitalization.
I have already applied for my extension as my course is of 2 yrs but I only recieved the study permit for one yr.
We can prove she will quarantine at home only as she will be taking care of my kid and need not go anywhere else during her quarantine.

Will applying thru phac help in my scenario

Is your spouse with you? The fact that your visa is expiring is one of the big issues. Your due date and the expiry of your visa are in the same month so she is trying to visit someone who may soon be out of status.

PHAC is not for your scenario. You want to use a PHAC to help you care for your child. That isn’t the purpose, it is to provide urgent, end of life or compassionate care for you not your child. This is not your situation. A PHAC doesn’t get around not needing a visitor visa anyways. Saying in your cover letter that she is coming to help is considered work, which is not allowed. Again you are on a student visa that expires in April. Once you get your study permit extension approved, apply again addressing reasons for refusal.
