I applied for CEC in june 2014 . Till now I have received my AOR only.So today I got an email from cic that my employer is not confirming my assistant manager position and they wanna ban me for 2 years for false information. They have given me a month to get a letter from the employer. My old employer is not there anymore and they wont confirm my job . My question is if I withdraw my application would I still get the 2 year ban ?????
 
I am sorry to hear this. Approaching this with common sense, if you withdraw your application NOW, they have even more reason to believe that you provided false information. It's a true dilemma, since you might never get the confirmation from your employer. :( Keep fighting!

Did you and your employer have an argument in the past or why does he act like this?!

Really sorry to hear that. Unfortunately, CIC have reached to a point from where they gonna ban you for 2 years even if you withdraw your application now. You have a convince them that you were assistant manager somehow.

1. Did CIC call your employer or got something in written from your employer?
2. who did sign your employment letter?
 
I had no arguments with my employer at all. My manager himself approved the job title and didn't got it approved by the HR of the company. CIC talked to the HR and they said I wasn't the assistant manager at all. Should I talk to an expert immigration lawyer or No ?

What do you mean by not there anymore?
I suppose you were working in a company? The company has HR department that issues employment letters? Where did all this go :o
If you had no argument with your employer resulting in him not supporting your application, there is absolutely no reason for not giving you the letter

Maybe you can get in touch with CIC and show them anything you can think of as a proof of your employment
- Pay stubs
- Document showing your title signed or stamped by the company

- Try discussing with an immigration consultant..

This is no good :( my letter was signed by my manager as well not HR :'( :( :( :(

They can call any time during the process if they have any doubt. My employer got a call from CIC last month.

original job offer
Signed contract
wp/LMO?

Contact your former company, and former supervisor to get some kinda

FYI - Misrepresentation ban is 5 years (not 2 years). It used to be 2 years but was increased to 5 years last year or the year before.

do you have any other proof from your previous employer that indicates you were hired/working as an assistant manager ? e.g. email with your signature including title, offer letter, pay stubs, etc.

Also, did you try going to the HR with your experience letter that indicated you were working as an assistant manager ? Try explaining them the scenario and the title you were hired under.

Were you granted any promotion during your employment ? Were you actually working as an Asst. Manager ?
 
Sorry to hear that but its just weird. What's the contact information you left on the employment letter? They should call the number you provided right? Why you provide HR's number. You should provide the number of your line manager who signed your letter

As I know many HR usually does not confirm the roles and responsiblility of the employee only your line manager can do that. So I would just ask your previous manager sign another letter indicating that HR doesn't know the detail of yout job and it is manager's responsibility to confirm the roles and duties.

Also whats your NOC code and did your salary meet the mid range of that NOC code? Lower tham average salary can trigger the investigation probably that's why they call your HR to verify.
 
Reach out to your former boss and ask him to confirm your job title + duties and explain the situation to CIC. HR might have not been aware you've been acting assistant manager (or the people in HR who were aware of that might no longer be with the company too) - there might have been no permanent record. With a good explanation backed by your former manager (and possibly other employees if you can reach them) not only you should avoid the ban, but also get your PR.
