Hello,

My husband had previously applied (oct 27,2014) through CEC for his PR but we still have not heard back and it appears many are getting their applications returned. I am a PR and have been for decades and was curious how long would it take to receive the initial response if we reapply under family sponsor? We both are located within Canada but worry as his work visa will expire as of the end of May.

Yes it looks like applications are getting returned and are required to apply with express entry profile.

Ar you planning to apply in-land or out-land.
The first stage of the outland application is taking about 85+ and then it depends on the visa office of your husband (where is he from?)

If in-land he could quality for the pilot open work permit which are being issued after the application has been confirmed about 4 months.

NO! Apply OUTLAND (which can be done even if he is IN Canada).

Applying Inland would be a major mistake, IMHO, because you'll likely celebrate at least 2 birthdays before he has his PR, compared to ~ 6 months if he applies Outland.

The majority of American applications are processed in Ottawa. Only those applicants that have `red flags' (criminality, questionable relationship with their sponsor, etc.) are actually processed in LA.

As you might be aware it is suggested to do an outland application since it faster. So if you apply say this month end you should theoretically get your SA by May given the current wait times ad outland US applications are much faster as well since most are getting processed in Ottawa.

I am not sure about the work visa category if it can be renewed ( I presume you cant).

I'm usually the one saying that! LOL!

Haha! We should keep a tally board with you two!!

Thank you for all your feedback. The call center hasn't been anywhere near as great with providing us information sadly. How does one go about applying outbound? Sorry.

@ Applechunks - haha good idea

A good starting point is http://www.cic.gc.ca/english/information/applications/fc.asp#immigrate

Which has all the documents, forms etc. Apply for the FBI certificate since it takes the longest 85 days and in the mean while you could start gathering all the documents and apply and then send the FBI clearance later on.

Also check the country specific PDF also in the link.

There is also this from another thread

"Reports from FBI Channelers are now accepted by CIC. They are usually much faster. You may want to give this a try

Unfortunately, Channelers will not mail the report to an address outside of the U.S., which means that a person In Canada may have little choice but to wait the 16-18 weeks (per the FBI website) for an original to be sent from the FBI.

If I apply as outbound, will my husband be able to get a work permit allowing him to continue to work from within Canada?

no outland applicants are not eligible for work permits. using that as a reason to apply inland is a big mistake many make and soon regret.

He's on an LMO at the moment. Is that going to affect my ability to apply for him as outbound?
