Hello Everone,

I have a open work permit expiring in 4 months and i have a question

I am working a good job and thinking of getting married so if i get married within couple of weeks and my spouse apply for immigration who is a canadian citizen can i still stay in canada as i don't want to leave my job?

No. You need to have some sort of visa to stay here. I don't know anything about work permits so maybe you can extend it or apply for another one. You have 4 months to figure it out.

Getting married won't help you or give you implied status though. Once you're married you can apply for residency if your spouse sponsors you but it's a long process and if you want to stay in Canada you have to have a valid visa.

So far, nobody has been able to confirm if CIC has in fact changed the rules that would now require an applicant to have legal status to apply. The rule/policy from Feb 2005 allowed a person without status to apply if s/he had an eligible sponsor and may still be in effect today, since CIC has only updated one section in the Inland Guide.

But if you have no visa can't you get ordered to leave? And once you leave they chuck your inland app in the garbage do they not?

`Once upon a time', CBSA had an Administrative Deferral of Removal policy of their own, that worked in tandem with a person without status that had submitted an Inland application. Basically, they would look the other way (or request CIC to expedite the processing of the application within 60 days) until the applicant had reached stage one approval, known as AIP. It has been reported that the CBSA policy ended in November 2011, but...there have been people here that have been able to remain in Canada without any problems. A couple of those people have landed as PRs recently.

So, technically...a person without status can in fact be removed, but many are not. It is true that if the person is removed, it kills their inland application. This is why some members here suggest that a person (even without status in Canada) submit an Outland application. If the person is removed, the application continues to be processed. Personally, I don't completely agree with those opinions, but...

Okay so other's have answered in regards to you overstaying... however, if you continue to work, which you have said is why you don't want to leave, then you do in fact need a visa. Yes there are open work permits issued to inland applicants now who are in process. However even if you got married today, you need to factor in the time it takes to prepare your application and I don't think they are processing fast enough that you would have the permit before your visa expires. If you stay and don't work, you may be able to get away with it, but if you work illegally, that will probably result in removal and exclusion.
