Need help with documentation for spousal sponsorship

Hello everyone,

I am looking to put in a spousal PR application for my wife(applicant). I recently got my citizenship (apr 2022) but haven't got my passport yet. My wife is in India and we got married in Feb 2021.

I am pretty new to this process and wanted to verify if the below-mentioned list is correct and complete:

1. Forms:
  • IMM 1344: Application form (Applicant)
  • IMM 0008: Generic Application form (Sponsor)
  • IMM 5532: Sponsorship eval and relationship questionnaire (both)
  • IMM 5406: Additional family information (Applicant)
  • eIMM 5669: Schedule A – Background/Declaration (Applicant)
  • IMM 5562: Supplementary information – travel (both)
  • IMM 5475: Authority to release personal info to a designated person (Applicant)

2. Application Fees
3. Applicant:
  • Passport
  • National Identification Cards
  • Birth Certificate
  • Police Clearance Certificate
  • 2 x Passport Photographs
  • Medical exam (at a later stage)
  • Visits proof from sponsor
4. Sponsor:
  • Canadian Status
  • NOA
  • Employment Agreement with Canada Life
  • Licenses
5. Both - applicant and sponsor
  • Proof of Funds: Bank Letters, Bank Statements, Employment Details, ITR / NOA
  • Proof of relationship: letters, text messages, social media conversations or other documented proof (max of 10 pages)
  • Proof of Marriage: Marriage Certificate, Photos of the wedding, customs, outings (max 20 pics), Brief description of the context of each pic, Documentary evidence of financial support between you and your sponsor and/or shared expenses, Proof that your relationship is recognized by your friends and/or family
  • Education Records
Queries:
a) Do I need to fill out the form IMM 5476 (Use of a representative) if I would need to have access to my wife's information?
b) What about the form IMM 0008DEP: Additional declaration?
c) Is there any other documentation that I am missing here?
d) I read about the new portal where application needs to be submitted but couldn't find it. Is submitting application the regular way better or via this new portal?

Unless things have drastically changed since I submitted my application in January 2021 (and I don't think they have) there's an ircc generated checklist for you that actually needs to be included in the application, so use that for being sure your application is complete.

a) Yes if you want to have access you need to be the representative.
b) not 100% sure off the top of my head but I'm pretty sure that IMM008DEP is only if you have additional dependents (kids) you're sponsoring
c) look at checklist carefully and work to have the best possible documentation for each thing like proof of financial support
d) It's a pilot program so I don't think anyone can say yet if it's better or worse.

I went through the checklist and it seems like there isn't anything additional. But I read some other threads where people also included a letter of intent (LOI) for both the applicant as well as the sponsor. Did you submit an LOI for your application?

Also if you can advise me on what can be included for the underlined part?

I don't think a fourm is the right place to be if you are starting out confusing who is to fill forms out and need help on which forms to use and why. You need a lawyer. Do it yourself can work but it's not as easy as you might think and can have many pitfalls. Get some good legal help.

I am correcting this incase someone else reads your post and believes this but am in no way providing legal assistance.

IMM 1344 I have never seen done by the PA before. As I said get legal help

First, overall, I think most of your questions will start to become clear when you actually read the instructions and go through completing all the forms. Come back and look through the forums when you get stuck on or wish to confirm individual bits - or more bluntly, a great big list of questions when you've just downloaded the package isn't a very effective way to work. As you use the forums to confirm what you're doing - ideally checking the forums and reading first, and then asking questions - it will all seem less intimidating, esp as you do it bit by bit.

b) This basically is only when the family has more dependents than can fit on the main form.
d) there is no advantage so far to applying online. If you can't find the online portal (it's still in beta basically), you're probably not the target audience.

Show your family/friends recognize your marriage: lots of ways, but eg them attending marriage and being in photos is a good strat.

No we didn't have a letter of intent per se, but we did have a letter of explanation for a couple things (supporting docs for plans to move to Canada as my Canadian citizen husband was living with me outside Canada at the time etc).

As armoured suggested, start working through the forms and the checklist and then I think you'll have a better understanding of what you need and questions you ask then will probably be more specific and you'll get more useful answers. Unless there's something you haven't said that makes this a not straightforward case, I personally think you can do this without a lawyer. I know when I started I was super confused but actually filling things out and working through the list made it all make sense. ;) Also for forms that are about the sponsor vs primary applicant, either spouse can do the actual filling out, doesn't have to be that you fill out all forms relating to the sponsor and your wife fills out all forms related to herself. Obviously you both need to carefully check over each form and make sure the right person signs everything.

- Under the National Identity document, are they referring national identity document from India or from Canada?
- Under Language detail, for the question: have you taken a test from a designated testing agency, should I respond Yes (because I took IELTS in 2017 for my PR app) or No (because the IELTS I took is expired)?
- Under the Dependent Section, Q11 asks whether my spouse will accompany me to Canada. Now they won't because we don't have a visitor VISA. Is that reason justifiable?

Sounds like you are still making the same mistake of not understanding who is to fill out what form and confusing who is the PA and Sponsor. really think you should look for legal help and not the forum but that's my two cents

IMM0008 is filled out by the applicant, not the sponsor.

If you have Canadian citizenship, you cannot be the applicant.

Go back to instructions and go step by step.
