Need help with CEC application - employer is not giving pay stubs

One of my friends is a software developer, he is working in Canada from Oct last year and now wants to apply PR under CEC.
Now his situation is bit complicated, for first 6 months he was working as a contractor to a company.Unfortunately this employer did not issue pay stubs. But for last 3 months of the year 2013 he has his T4, and for first 3 months of this year he does not have T4 or pay stubs (basically no proof of employment). Fortunately from the month of March, 2014 he got hired in a company and he has all necessary docs after that time.

Can you guys suggest how he can proceed with his CEC application, what would be the best way.

He is working and no paystubs :eek: , How he would have filed Tax returns in turn how he will get T4 and NOA for that period ?

First of all how he get salary from employer without paystub through bank

There is something called "Cash" Also my friend , But i really doubt that happening nowadays

If he worked on a cash basis, then unfortunately it will be difficult to convince CIC that he was a valid employee.

If it's direct deposit, you can still ask for pay stubs, because the payments are all on record...

Still you should be able to get pay stubs, cash or not. I don't think the business is run properly if they don't even give you pay stubs. CIC would probably have the same doubts...

What my friend is telling me is that his first employer was not particularly happy about him leaving the contract, so his employer is not issuing the pay stubs. For last year employer just issued the T4 so that he can file for his taxes. For this year he has nothing.

Are their any legal action which he can against his employer, only thing he needs from his employer is pay stubs, right?

Doesn't need paystubs. Whenever someone leaves or changes a position (or is terminated), the employer is REQUIRED to file a Record of Employment with Service Canada. You can get a copy of your ROE from Service Canada if your employer has complied.

The record of employment covers your entire period of employment - dates, hours worked (if you're hourly), and payments.

This will be enough until you can get the 2014 T4 next year.

But - question - how will he get a letter of employment from this employer?

I think, employer reference letter is more important than the paystubs. If the employer is not willing to write a reference letter, how will he prove the duties that he performed during his job?

Hi

All employers have to file a ROE with Service Canada, in addition T4's & NOA's have to be issued. I never submitted any pay stubs but only NOA's & T4's and it has been no problem.

However the reference letter will be if the employer is not willing to issue it, I agree that this is more important.

Not sure why the focus on only pay stubs when the reference letter is also needed?

Hello Guys, thanks for your posts here. The thing is my friend is not going to get the ref letter from his first employer. So he was planning to write a cover letter explaining the situation and back it up with T4s and stubs.
As per your suggestions he checked with Service Canada and unfortunately his employer didn't even submit the ROE it seems. So he is going to wait another 5 months so that he completes 1 yr with his current employer and then apply for CEC.
