Regardless of the mother abandoning the child, the fact remains that you know the child mother's name and that should be on the birth certificate. The Canadian authorities will be interested in knowing about her so you cannot run away from that. They will also need some form of documentation from either the court giving you legal custody of the child. However, I am no lawyer and you can double check on that last point.

The child will have to be in Canada and get PR status, but those issues mentioned above will have to be address first.

Wanted to make sure you have not been living with someone for 1 year already since you were talking about sponsoring a spouse already.

canuck78, why can't I live with someone before getting married and sponsoring for PR? Can you explain please?

You Ned to be declaring yourself as common law not single on all documents including taxes if you have lived with someone for a year already.

At least one of you must be living in Canada in order to sponsor your child for PR. That is one key requirement. Yes, you must be in compliance with the residency obligation to sponsor.

If I return in Jan 2026 in canada while wife&baby still outside. do I have to wait to complete 730 days first then I can sponsor baby ? Or I can right away apply sponsorship pr in Feb 2026 ?

*Days spent Inside canada till 31 July 2024= 502 days
*Days spent inside canada for spouse till 31 July 2024= 438 days

You don't have to wait. You will/can still meet RO before you reach 5 years after landing as PR. So you can apply to sponsor once you have returned to Canada.
