Need help please non accompanying child

Hi there and I hope someone can help me. My husband does not want his 10 yr old to be put through the medical. He does not want her to move to Canada and never wants to sponsor her. He understands why it needs to be done he just refuses. She has no medical issues or anything like that. If something were to happen to his ex, he says he will come back to the states, but she would be happier with his exes family than with him or us. She has told us she doesn't want to come to Canada at all and won't even let us get her a passport and doesn't want to visit either. I am thinking it's all a lost cause at the moment. I have read posts on the exes refusing but not the applicant. I have done up a declaration stating he understands he will never be able to sponsor her and he is 100% ok with that, but what will CIC think? I am thinking 2017 is going to be a refusal for my husband and I to be together. CIC has already requested her medical to be done, we applied Outland. Any help or advice or personal experience with this will be greatly appreciated, and no I can't change his mind or move to the states myself at this moment.

"be put through the medical" - my daughter is 11, was 10 when she had hers done. They didn't do blood work, they didn't need an x-ray, it was less thorough than the yearly exam she gets from her pediatrician and was pretty painless. She had to pee in a cup for the first time, but it wasn't traumatic. I'm baffled by his attitude. Does he think there's something about the exam that makes it more invasive or intense than it actually is?

That is just the way he is. i explained it all to him over and over and the strain of it all is getting to me. He does not want to sponsor his child ever to come to Canada, period. She doesn't want to go either. I talked to her today and no go. I suggested getting her passport to her today and she refuses to have anything to do with it. She isn't my child so I don't really have a leg to stand on cause if she was mine she wouldn't have a choice. As his wife I have to respect his choice cause I have tried to convince him otherwise and I am getting no where. Thank you for your response

I wish you luck. It would be nice if CIC had some procedure for circumstances like this, where the non-accompanying dependant will never be coming to Canada at all and has no interest in being involved in the process. It seems to create unnecessary difficulty for some people.

He is still in the States and will stay there until/if he is granted pr. I have no idea what she is being told. As soon as I thought Everything was getting straightened out, I took a huge leap backwards tonight.

i dunno sounds complicated, how long you and him been in this journey I am sponsoring my husband inland our journey started Dec 14 2015 and a year to go would you ever live in the us

Generally, IRCC grants exemptions when the applicant shows that they are unable to have the dependent undergo the medical.

Given that in your situation, it is the applicant choosing to refuse to have the dependent's medical done, I don't know how IRCC will handle the situation.
