My passport was submitted at the mid of Nov, together with a self-explanatory letter telling our plan and thoughts of returning to Canada.

I received a letter yesterday that my application is intended to refuse as we don't have enough proof showing our intention to move back to Toronto.

Wife, HK, sponsored person.
Husband, Canadian citizen, Sponsor.

What do you all think if we buy a flight ticket ( one way ) to Toronto ?
As my husband have job in HongKong, he can't leave at the moment. He needs around 3 months of notice of resignation.

Can he apply for the resident and Health card online ? Or he need to fly back to Toronto for that ?
Do u think it shows his intention to reside in Canada ?

If I go to Toronto as a tourist, I can stay there up to 6 months. I am from HongKong (Visa-exempted for tourist)
Can I work if I am a tourist ?

What can I do / provide to show our intention to move back to Toronto ?
Anyone advise ? Appreciated for all of your reply.

He will be OK but the airline may refuse to sell you a one-way ticket.

He doesn't need a "resident card and as a current non-resident, he is not entitled to a "Health card".

No, it looks like he is trying to "convince" the VO. This will be seen as a cynical attempt to meet the requirement.

No, you may not work as a tourist.

As he has already failed to demonstrate "intent", the burden of proof, in my opinion, is likely to be much higher.
Maybe he should resign and move back, with or without you, and set up residence in Canada again.

I think he need to request for relocating back to Canada for his job first.
Although his company may not reply an offer for him within a month, at least we can show the correspondence email to them.

We planned to arrangement shipments of our stuffs to Toronto when the application is successd.
I think I need to do it now to provide the shipment documents.

For the MPF, do u think it works if he settled his MPF in HK ?

If I declare I am about to depart from HK permanently, I can withdraw it early, and this reason can only be used once in a lifetime.

This is one of the example ( stated in that letter ) that I can show the intention to reside to Canada.

I would advise caution. When dealing with CIC, "don't burn your bridges". Anything that is irrevocable should NOT be done until the whole process, including "landing" has been completed.

Have you or your husband corresponded with anyone inside Canada about your intent to return to Canada to live? Family, parents, cousins, friends, anyone? If yes, those people can write an avidavit stating they know of your intentions.

Have either of you looked into schools for children (if you have any), looked or spoken with realtors about purchasing/leasing a home to live in when you return?

Does your husband have any active bank accounts still within Canada?

There are many ways to show intent to move back. Buying a plane ticket is not one of them.

The VO is looking for proof that says you guys have thought this out and indeed this is what you both want to do and this is how you are going to do it.

Did you guys write an 'outline' and include it in your application in lieu of all these above things stating step by step what your intentions were in regards to coming back?

IE: Once approved we will cash out our MPF and my husband will request his intercompany transfer. All those process' will take about a month to complete at which time we will get our tickets to "X" where my husbands company is located. We have been looking online for housing in the "X" area in the "X" school district for our children (if you have any).

Things like that will go a LONG way to aiding the VO in feeling as though you truly do intend to return to Canada once PR is granted. Give it some thought and put together some thorough documentation and return it to the VO.
