Hello, I'm a Canadian citizen engaged to a Mexican national and we plan to live our lives here in Canada. She lived in Canada for nearly two years, just prior to the Canadian law requiring Mexicans to get a Temp Resident Visa to visit Canada, and applied for visa extensions and got them every time she asked (3 times). Unfortunately after she returned to Mexico to finish her studies she applied for TRV's twice and was refused for a variety of reasons. I contacted an immigration lawyer who read through the application package and was "perplexed" at why she was refused once, let alone twice. He said it was an excellent application package and was surprised at the result.

So we are getting married this fall in Mexico and will apply for sponsorship immediately. I'm just wondering what other people's experiences have been while they have been waiting for the 14 months or whatever it is. Have people applied for TRV's while they are waiting, so that she would be able to come visit me while we are waiting? Or would this seem unlikely because she has had TRV rejected twice? Our situation is a typical difficult immigration process of extreme emotions. We only see eachother when I get time off work for a couple weeks twice a year, and are feeling drained and frustrated at the immigration Canada blocking her from visiting me in Canada. I'm wondering if the best yet more frustrating idea is to apply for the sponsorship and just wait it out? Maybe applying for another TRV could be a really bad thing if it is rejected, then again I have heard rumours (for what its worth) that you are more likely to get a TRV approved if you are applying for sponsorship separately...I don't know. ???

Thanks for the reply Izzy. We are planning to do the sponsorship application as soon as we are married. But I'm wondering if it would be a good idea for us, in our situation, to also apply for a TRV while we are waiting for the sponsorship. Or even another idea is that she will be taking a technical school training when she is here anyway, so a possibility would be to apply for a student visa while we are in the sponsorship waiting period.

Since it has been twice denied already, I would not apply for another TRV. The rejections are fine and are worth mentioning on your spousal application because they prove that she did try to visit you in Canada. TRV for a non-exempt country are almost never approved with a sponsorship in progress because if the application is denied, they want to be sure that the visitor will leave the country.
My advice is to have your application as complete as possible when you get married so you can send it in right away. Ours took 2 1/2 months to complete. I am in pretty much the same situation as you except my app is already in progress. I wish you the very best of luck.

Thank you! Very kind! Must be Mexican! :)

I talked to a lawyer and he pretty much said the same thing about most likely not getting another TRV accepted while we are waiting for sponsorship. He did however say that it wouldn't hurt the sponsorship application so if we have thick skin try again and you never know - can't hurt (except for the money wasted on the TRV and the time spent on it). Anyway, I hope the best for you as well.

Dear Chauncey

I am a Canadian Citizen. I was married to my Mexican wife in Mexico City Feb 2012.

After we were married I applied for a TRV for my wife two times and was refused twice.

The reason for the refusal was " Your family ties in Canada", and employment financial status.

While applying for your novias TRV did you mention you were engaged ?

I know exactly the frustration you feel.

I suggest you apply for sponsorship immediately (after you are married).

I am in Mexico at this time comforting my wife and dealing with the Mexican Visa Office. Our frustration with CIC is beyond angry.

Please visit thread DIFFICULTIES WITH MEXICAN VISA OFFICE.

Thanks Mark K
