My WP Application Returned

Hi Guys,

I applied under CEC in February and it's in process. I applied for extension of Work Permit before my WP expired but my application returned to me for wrong payment method. I didn't know that I had make the payment online.

Anyways, the problem is not the payment. It's stated on the letter that ''a copy of an Employment and Social Development Canada'' confirmation required. Means LMO? I thought I'm exempt from LMO because I already applied for PR under CEC and my WP was expiring. Should I still go through the LMO process?

I'm not sure what the Employment and Social Development Canada bit is but you are NOT LMO exempt because you have applied for PR - I am not sure if work permit extensions need a new LMO though.

You have a much simpler option though:
You can instead apply for a BOWP (bridging open work permit) - it's a relatively simple process and I believe it's pretty quick to come through - assuming your work permit hasn't expired yet (but has 4 months or less to go), that you are still in Canada and that you have received your AOR, you will be eligible.
You will need to show your AOR though so if you haven't got that yet then you can apply by paper, which takes longer, but ask them to check for your AOR when they process your application. You would go on to implied status in the interim

My WP expired on March 14. Now I need to restore it again. I received my AOR on March 5. So, you think I should apply for BOWP? And for apllying BOWP which form I should use? IMM5710?

If your WP has expired I think you are not supposed to work in Canada legally (not sure about any grace period). Consult with your employer/lawyer immediately and act fast.

I called immigration already. Talked to 2 different people.

Looks like i have no choice but to go through LMO process again.

I'm lucky that my employer is very helpful. This will be my 3rd LMO application. My employer will call Service Canada to find out if we still need to advertise my position again. If we need to then it will take about 3-4 weeks to complete the LMO process and submit it.

I will also complete the WP application package and ask for restoration status. Also, I will attach a letter states that LMO result will be submitted later.

My question is that my WP expired and I need to resubmit it. While this time can I still work? I think i have 90 days from the day my WP expired to resubmit my WP application and I will still hold my status during this 90 days.

What do you think guys?

Quite honestly I dont know about this 90 days period. Please confirm with CIC or your Company's Immigration team. Its an issue for both you & your company if its not the case.
