she cant land in canada as a dependent without you signing the sponsorship document. without that, you are not liable for her financially. the laws in india are pretty tough for marriage. you should start consulting lawyers in india if you do wish to go ahead with divorce. just staying quiet in canada will actually make it worse for you in india.
 
Can't the OP be able to apply for a divorce here in Canada despite the marriage occurred in India?

unfortunately it's not so easy to file a divorce in india if one party isn't willing. the case for alimony can be pretty nasty.
 
Please know that you are not legally obligated to do anything for her. She might be your wife but she can't force you to submit the application. You are here and she is there, there is nothing she can do. If you have prepared the papers to apply for her PR throw them in the garbage.

If you were married in India, I advise that you get on the phone with an indian lawyer. Keep any proof you have that she only married you to gain entry into Canada. The lawyer will advise if there is a way to annul the marriage or how to start the divorce proceedings. It is very important to keep all proof that she frauded you. Once your lawyer contacts her for divorce she may turn the other leaf again, pretend that she loves you and has no clue of what he is talking about with fraud marriages.

If she is harassing your parents advise them to take matters to the police. Get a restraining order if it becomes unbearable.

If you don't know any lawyer in India, I suggest you seek out the New Delhi thread and ask if anyone knows a reputable lawyer in the area which you are from. I am sure they will gladly help you.

The others are right, you can apply to bring your parents here on a supervisa. you may want to look into that on the CIC website and consider it as an option. Also, she is wrong you dont have any obligation to give her money unless you sponsor her. You have not sponsored her yet so you don't have to worry about this.

nope. can be tricky to file a divorce where the marriage certificate wasn't issued. similarly someone married in canada can't apply for divorce in india.

So people who got married in US or visa versa would have to go back to country of origin to get a divorce? The OP may be get legally divorced in Canada but not recognized in India.
 
If I were you guess what I would do ? Take out the application that you have filled , ask her to come on Skype and burn them whiles she watch! Lol you are lucky . What you need right now is first get her off your parents backs! Then take time to settle since you are new in Canada , then start working on the divorce as soon as posible .

Getting divorce in India is not easy, law is all against men and in favour of women. Women uses the system against their husbands with false charges and there is no fixed time frame for divorce, it can take 5 to 10 years or more to get divorce in India. I want to give her divorce here.

depends on the country and marriage. for example common law marriage isn't accepted much outside canada. same with same sex. so "canadian marriages" aren't universally accepted everywhere. just as some US marriages aren't accepted every where within the country. also many countries don't have access to the marriage data and needs to be verified by the consulate. for example, marriage certificates from india has to be verified and notarized by indian consulate in canada when applying for PR. also divorce documents must be sent to the country of marriage so they know the marriage is no longer valid.

unfortunately you can't give her a divorce in canada unless both parties are present and even then i doubt it will be easy.

thanks for the information. So, it means that Only after one year of stay here, I can file divorce. If you get any information on divorce where wife or spouse lied for just PR visa, then please let me know. I thank you all from the bottom of my heart for providing information.
