i need advice. My spouse landed in March and since then had been physically and emotionally abusuve. He slapped my nine year old son on Friday. Now all signs point to the fact he's cheating on me...staying out all hours and won't tell me where he is. Is there any law that protects us sponsors from someone coming to Canada and showing their true colours? We haven't even had our two year anniversary...I am in a living hell...can he be deported even though he has his PR...please any advice is welcomed I am heartbroken...I can't even go to work anymore. What are my options if any?
 
Unfortunately, the Liberals have removed the two year conditional requirement for sponsored spouses, so theres really nothing you can do to deport him, but you can certainly have him arrested for abusing you

I was afraid of this. Can this be considered marriage fraud on his part? I'm beginning to believe I was used for the PR and the marriage is a sham.

You can inform IRCC about this but they may or maybe open an investigation based on your accusations.
 
Call the cops for him assaulting your son. You can report him for possible marriage of convienience, but that would be up to IRCC to pursue. As previously stated, condition 51 no longer exists, so help from IRCC will be minimal at best.
 
This is so sad to know there's no protection out there for me in terms of getting him deported after treating my family in such a horrendous way. Even with criminal charges against him he gets to stay in Canada?
 
Unfortunately, when they rescinded Condition 51, it left a lot of people exposed to fraud and abuse. Your best course of action is to involve the police. Depending on the severity of the charge and number of convictions, he might (and it's a really big might) end up being deported, but it's unlikely. The more documented evidence of abuse and marriage fraud, the more likely IRCC will move to investigate.

Regardless if you can have him deported or not, I hope you will begin the steps to protect yourself and son emotionally and physically, because his behaviour won't stop. If you can tell me what city or province you're in, I can try to forward you some resourceful numbers privately.

To have his PR status revoked, you would need to provide evidence that he used you to obtain PR status. Without evidence, IRCC will most likely just look at this as a marriage breakdown.

Agreed that if there's abuse, then you need to treat it as such and involve police / other officials as appropriate. Make this your priority.
 
If he ended up to be criminally charged, he may not be able to get his citizenship. He may or may not lost his PR. But that likely won't be an immediate deportation.
So protect yourself and your young son and report to police.

Actually there was a clause that would allow those in abusive relationships to be able to override conditional 51. No need to feel forced to stayed in abusive relationship to maintain PR. There were protections for those in abusive relationships from losing their PR. Since the Liberals rescinded it, the Liberals exposed more sponsors to marriage fraud than before while protections for victims of abuse remained the same.

I agree. In some traditional cultures, it is hard for people to get to know each other before marriage. But that 2-year law was so cruel in my opinion because a lot of marriages are not fraud and it removes productivity from the applicant (finding a job, contributing to society).
Regarding to te question of @Em2018
I am sure there are kid protection laws in Canada (regardless of whether the person who perfomrs the act of violence is a canadian citizwen or a PR holder). You should report him to the police. Take care.

As already said, there were exceptions in place for victims of abuse. There were people on the forum in that situation who retained their status because of that. If someone did stay in an abusive relationship while Condition 51 was in place, it is likely that they would have stayed even if Condition 51 hadn't existed. Such is the reality of most abusive relationships.

As for the comment about productivity, I'm not sure what you mean. A PR with Condition 51 had the same right to work as any other PR.
