Hello

Having been here and there, I found the easiest and most practical solution is to leave Canada and apply from abroad (outland).
But how can I get there? that is the new burden and hell of life. I can go and be a refugee in Jordan or Egypt. All airlines are refusing my booking, because I need a visa, just to fly over USA or Europe (just fly or transit). I can not get that visa.
Any suggestion? any idea?

The reason noone is responding to your question is that you're not being very clear on your background and others may have not read your previous thread. You either need to be more specific or repost your question on the old thread.

contact your embassy. it's your only option i think. not sure how you are going to explain your situation, but honesty maybe your only choice. i hope for the sake of your wife and baby you are able to work it out. good luck.

Ok who told you that you need a visa just to fly over the US or Europe?If you have your passport thats all you need.I have never heard of anyone needing a visa to fly over another country?To land in another country if you have a layover yes but to fly over i have never heard of this.People fly over the US all day long to go to other countries and never need a visa to do so.

Why are you leaving Canada? It may be a mistake for you to leave.

How come the airlines are refusing? If you get a transit visa, all you have to do is pay at the immigration... If you just fly over the country then there is no need for you to get a visa.

And i was wondering how will you be able to leave Canada if you were not supposed to have come in the country in the first place?

As we have suggested in the other forum, please do consult a lawyer before you do anything drastic. I know you've mentioned that you cant afford the fee, but you can get consultation and I think it's free.

You should really reconsider leaving Canada before you have gotten legal help. It could be a big mistake. Illegal status in Canada does not prevent your wife from sponsoring you. The only question is how you got to Canada in the first place. Do talk to a lawyer before you do anything further.

scylla, I have seen his other posts. If he stays in Canada, his problem is to explain how he got in but even if he left, he would still have to explain how he got into Canada because if he claims he was never in Canada in the first place, how does he explain that he met his wife, got married and has a baby. Leaving could also cause him other problems such as not being allowed back. I have told him on the other thread as well as here that he should talk to a lawyer before making any decisions. He says he can not afford a lawyer but he can afford the flight to go somewhere else?

He absolutley needs a Lawyer, pretty messy situation. Leaving the country def wont solve the problem. I suggest calling around until you find a lawyer that will accept a retainer you can afford. Alot of lawyers will work on a payment system, Make sure you get a lawyer who has dealt with something similar to your case. When i used lawyer i vetted many before i settled on mine. A good lawyer will be blunt honest with you on your chances of success and they wont mind disclosing their success rates on cases.

I suggest you look for a lawyer if you haven't done it so. Lots of people in this forum aren't lawyers and know things based on what they have read, some of the comments are completely non sense. Maybe you don't have to leave the country at all. Look for a lawyer! Good luck for you!

well there's a chance when they find he entered illegally they go ahead and issue removal order. A good lawyer will try to get that defered pending outcome of sponsorship app. A good lawyer will also be honest and tell you chances of succeeding and may adivse you to apply under H&C stream. But thats only speculation, one thing is for certain when they find out you entered illegally they will move forward with removal, just having application in process most likley wont stop that because you have commited an offence against the IRPA. Wether you leave or file inland you have obsticles that require a lawyer, chances of succeeding without one are slim, and if you apply outland and lie about being in Canada you will have problems proving relationship, and you will be commiting misrepresentation
