Hi all I posted here a couple of weeks ago about our application

Hi I am an Irish citizen and I have been in a committed relationship with my girlfriend who is a Canadian citizen by birth, since 2011 and we were living together in Toronto from November 2012 til July 2013 when we moved to Ireland and have been living here together since.
so I reckon we're about half way through our application. I just wanted to post up here what we have done and maybe you guys can point out what we need to improve on or delete. Any help would be appreciated. Here's part 1 the sponsor section of the checklist.

-Application to sponsor (IMM1344) completed. It looked straight forward enough.

-Sponsorship evaluation (IMM5481). We filled this form out stating that Chantale is unemployed and that I am supporting her. Would this have a negative impact on our application?

-Use of Representative (IMM5476). We are not using one so do we still submit a blank form, or maybe write N/A across it or leave it out all together?

-Reciept (IMM5401). We haven't paid for it yet so there is no print out.

-Statutory Declaration of Common Law Union (IMM5409). Do we need to fill this out? It states in the checklist to submit it "if you have a co-signer and he or she is your common law partner." I'm confused by the wording of this. We don't have a co-signer, unless my common law partner is considered the co-signer.
Also on Section 5 of this page, Do we really need to make a declaration with a commissioner of oaths and who qualifies as a Commissioner of oaths?

-Sponsor Questionnaire (IMM5540). Almost completed. Was wondering if a letter from a potential future landlord stating that an apartment was available and offered to us upon our return to Canada, would qualify as intent to move back to Canada to live. Also could you tell us what other forms of evidence that we may not have thought of already that we could use?

You don't have a co signer, that's only if you are sponsoring someone else and your spouse is agreeing to help financially support them. You may want to do the declaration of common law anyway as proof of your relationship. Even though it says "only do this for a co signer" there have been people on here who submitted a common law application and were asked for the declaration later on as proof. For any unmarried applications, more proof is better than less.

Generally no, at least if one or both of you should be employable in Canada. CIC will care that you will not rely on welfare when you immigrate, but other than that there is no income requirement to sponsor a spouse or common-law partner.

It is not necessary if you are not using a representative.

You will obviously need to do this to file the application. The right of permanent residence fee is not required at first, but including it means that they don't have to ask for it later; the request can slow down processing.

It's a good idea. CIC has been known to ask for it later on for common-law couples.

A commissioner of oaths is a notary public. The notarization is necessary, which is what makes a "statutory declaration of common-law union" a statutory declaration rather than just some form you've signed.

It would help qualify as intent. This point is a bit fuzzy, so more evidence would probably be better. Thinking as a hypothetical, skeptical CIC agent, you might want to include some evidence of how you intend to support yourselves upon arrival in Canada, either evidence of a job search or letters of support from family.

Based on just the information you've included here, it would be reasonable to ask why you'd move when PR is granted if you have every financial reason to stay in Ireland.

Make sure you do your upfront medicals and police checks . Letters from a friend or family would also be useful stating that you have a place to stay while waiting to get an apartment.


The letter is good from your landlord. Job search is also a good piece of evidence. Pay your fees upfront if you can manage it and double checks the forms are still in date before you send it off.


Track your parcel also so you know when it arrives in Canada ..

- Additional Dependants (IMM0008DEP). I haven't done anything with this. Is it just for people who are travelling with other family members? Do I have to fill anything out regarding myself or do I even need d to include it?

- Background / Declaration (IMM5669). When filling this out I found it hard to remember dates specifically regarding employment/unemployment, education and when I lived in different places. I've moved around a bit in the last ten years.

- Sponsored Partner/ Questionnaire (IMM5490). We've completed this but Q.27 dates we've lived together. We've lived together since 2012 up until now, do we put in todays date or leave it blank?

- Additional family (IMM5406). Again is this just for people who are bringing kids or dependants? Do we need to give any information or include this form?

- Use of Representative (IMM5476). Again no use of a rep.

Hi

IMM0008DEP - Don't need to include, mark N/A on checklist.

IMM5669 - That's common, just put down the info as best as you can remember it. If there is anything big that you are unsure of, explain on a separate sheet.

IMM5490 - You can just put in the date that you sign the form.

IMM5406 - I don't understand why so many people think that this form is optional when it is clearly listed as a required form. Fill out in full, listing everyone as requested.

Since you girlfriend is a Canadian citizen, did she have to do a medical/provide police report?

I am a Canadian citizen and sponsoring my common law and I am very confused about some of these things as well.

Anyone here willing to provide some help with the IMM5481 form? I'm sponsoring my spouse yet he has a child that I am not sponsoring. His portion of the application requests info about his dependant so I put however I'm not sure how to answer the questions related to undertakings on my evaluation.

The child is still required to be included even if they are not accompanying. Provided you have no other dependent children and have never sponsored someone before:

Thank you for the response. I do have a child whom I support. The thing that is confusing me is that I am not sponsoring his child but did indicate that he has a dependant on the generic application. So based on that information, would I still need to indicate 2 for question 5a even though his child isn't coming?
