Hi all,

I am new to this forum, and would like a little help with deciding whether sponsoring my husband by way of an outland application is the way to go. I just got married this past Saturday (November 24, 2012), so all I am waiting on is my marriage certificate and my husband's fbi clearance to submit my application. My husband lives in Buffalo, NY and is currently going to law school at UB. I travel to Buffalo every other weekend and he comes here on the weekends I don't go to him. Is it true that we wouldn't have travelling privelges if I apply inland? We need to take the fastest route as he graduates in May, and takes the bar in July, so he needs to come here and work while taking his exams to become accredited as a lawyer here.

Can anyone give me an idea of how long it will take from your experience?

Thanks a bunch!

Rachel ;D

When applying In-land they say (CIC) you shouldn't leave Canada because if for some reason you are denied entry back into Canada your application will be considered abandoned and rejected. If he is attending BU then you should file Out-land therefore traveling back and forth won't be a problem. In-land is taking 6 months for first stage approval which would then give your husband the right to work in Canada as long as you file for a work permit with the application but it then takes another 8 months to get his PR visa so In-land is totaling 14 months. I filed Out-land and had my PR in hand and was landed in 7 months from start to finish tho the website is posting 12 months. As an American being visa exempt for visits it is just alot easier to apply Out-land I believe most people who apply In-land are people who need visa's to be able to stay in Canada because once the application is filed they are able to remain until a decision has been made.

Thank that helps alot! Is there a difference in the application you fill out or is it just that you send it to a different place? Will there be an option that says are you applying inland or outland?

Also, how did you put together your package? Did you use a binder or tabs with a table of contents or was everything loose?

Lastly, did you take your medical examination in Canada? And how long did your FBI clearance take (we are just waiting on the FBI clearance and marriage certificate)

Yes, there's outland forms and inland forms. You also send it to a different place. This is outland forms: http://www.cic.gc.ca/english/information/applications/fc.asp
It goes to CIC-M.

Also, how did you put together your package? Did you use a binder or tabs with a table of contents or was everything loose?

I put them in three different envelopes. One with Sponsor information/forms, one with Applicant information/forms and one with additional evidence. it ALL was loose in the envelopes. I just put a rubber band around them all and had a sheet at the top stating "Sponsorship Application for *applicant name*" Do NOT NOT NOT use a binder. You will just really piss them off.

Lastly, did you take your medical examination in Canada? And how long did your FBI clearance take (we are just waiting on the FBI clearance and marriage certificate)

Hubby got his done in Kingston, Ontario, was 200 bucks. And our FBI took about 6 weeks.
Here's my blog post detailing the outland process for American's :)

Good luck!!!

thanks parker24. how far along in the process are you?

Once complete, I send the application to Mississauga, then when I'm approved to be a sponsor, the file automatically gets sent to Buffalo correct?

After your Sponsorship approval your file will automatically be sent to OTTAWA (Buffalo isn't being used for this type of application any longer). And, Parker24's blog really lays out the process well!

I too have an American husband :) We are currently living together in the US, and have just sent our application in Nov. (We have been very fortunate to have my sponsorship approved already.)

Best of luck to you!

We sent ours out last February. My husband is also an American and we are living in the US till next spring. We sent ours all in in one large envelope and I had paperclips on each form. Our whole application got sent back to us (husband failed to sign one form :-X) and when we got it back all the paperclips were gone and you could see how they flipped through all the paperwork and made a bloody mess of it!! When I sent it back(after double checking he signed and dated everything.. I might have been hovering a bit...lol) I arranged it all with post-it tabs, one colour for "to sponsor" one colour for "person being sponsored" and one colour for the re-filled out and signed forms and a 4th colour for the original un-signed but date stamped of receiving date. All in all our paperwork weight a bit over 4 lbs so it fit in just a large fedex envelope. I would have worried to much having separate envelopes! We are still in the sit and wait but it seems like at least stage one is moving a lot faster now then it was when our file got there!

Thanks,

Is it okay if i type in the majority of the fields, and hand write in some others in black ink?

Also, there is a section where my husband has to list what he is doing in every stage of his life since he was 18. Did you attach an additional sheet? There is no way he can fit evertything in the space given!

If you mean write something like N/A or PRESENT (in a from date thing) then yes that's fine. Just make sure it's easy to read :)

And yes, we had to attach additional sheets too! Hubby moved quite a bit and had several jobs so we needed the extra space :)

I read your blog post. Thanks btw. ;). Just to check, if we are submitting in January 2014, he ( my husband is sponsoring me, his American wife), he only needs the info from CRA for the previous year only? And if he is living and working in Canada, does he need a letter from his supervisor also? Thanks in advance.

Yes for the CRA thing, I should edit that ::)

The letter would help, I added a letter from my employer saying I actually got the job and how much I was making was in it :)

That's what I figured ;) but it doesn't hurt to check. I will let my fiance know about it so he can ask way in advance (may take a while).
