Hello all, again.

Must be married two years before we re- apply?

We were married July 29,2013; had only written to each other for two months. Applied for spousal imm’ , was refused. Hong Kong office.

Now I have lived with my wife in China for seven months, have good proof, photo’s, prepared documents to show how our marriage has evolved, and we now know lots of each others family and our backgrounds.

Question: Should we apply in Jan. 2015, or wait until July 29,2015, when we will have been married two years.

Missisauga is taking 45 days to approve me as sponsor, and Hong Kong timeline is 9 months., so by the time Hong Kong looks at this , it could be after July 2015. Would that qualify as being married at least 2 years?

We feel that because of our “quick marriage” the 2 year time period is a big plus.. Your thoughts, please.
 
I would just apply again ... Looks like you have lots of proof.
 
there is no rule that states how long a couple must be married before applying. people apply soon after marriage all the time and are successful.
it's not about how long a couple is married, it's about how long they've known eachother, how long they've been in a relationship together, and how they portray their relationship to family and friends.
 
Thanks, that builds confidence. Some Lawyer in Beijing (has an office in Toronto) told my wife that we had to wait 2 full years. Lawyers!!!!!
 
I got married the end of Dec last year and filed in April .. Its how you present your application and explain your relationship .
 
The only benefit of being married for 2+ years is that your wife avoids Condition 51 (which is a non-issue for most legit marriages). Otherwise it does not matter.

Because you were refused once, it is harder to win the second time you apply. You need more proof the relationship is genuine - and not just more of the same proof, but different proof. You now have that, as you have been living together. It is true that it is usually better to apply as soon after getting married as possible, but maybe not in your case. If you continue to live with your wife in China, there is no hurry. The longer you stay together outside of Canada, the more genuine the marriage looks. Unless you are a PR and have to go back to Canada for residency requirements, in which case applying now would be better.
But if you wait until you have been married two years, that also means your wife will get a PR with no conditions. However, the conditions are really to protect the sponsor: if your wife leaves you right after arriving in Canada, then if she has condition 51 on her visa, she can be sent back to China. If you are married for two years before applying, the visa has no conditions, and so if she leaves you you will have to support her for three years (if she goes on welfare.)

Why did they reject you the first time? Maybe that would help the other posters how to respond.

Read his previous post history. IIRC they were married immediately after the first 'in person' meeting and applied to immigrate immediately. CIC, for obvious reason, assumed it was a marriage of convenience.

Now that he has lived with his wife in Chine for several months, they have built a stronger relationship and bonded and CIC will look at this new information to make a decision.
 
Yes, the first time we were naive . Now my wife knows my families names, where they live and what they do. Has met them on qq. I know her family well. Had many dinners with them all. We have traveled to seven cities , taken sleeper train, bullet train, tour bus and car trips.

She is learning English, so now we can talk together. We would go on Sundays to "Guilin English Corner", where locals meet to learn and practise English. We talk daily on qq video.

My print outs of emails and qq chats is about 2 inches thick of papers. Should i cut that down? Thanks (Xiexie)
 
No wonder they refused! I would wait as long as possible before reapplying, as long as you two are living together.
 
Thanks Canadianwoman; I came back to Canada October 28, 2014. I do not plan to go live with my wife again. The long trip ages me, and is expensive. Cripes, i am already 74 years old.

Should we still wait until next May or June? (married 2 years in July) Or no point in waiting, as we are not together....your thoughts again please..
 
I think, now that you are back in Canada, you can apply as soon as you get all your documents and proofs ready. Since you are spending time apart now, I don't think it matters. The important thing is that you already spent a lot of quality time with her, and got to know each other better.
 
Thanks Kayaker; Definitely know each other better now. Our cultures are very different; get used to that and it is easier going. I was treated very well in China, and never felt out of place.

I wish i had known of this site long ago. Thanks to ALL.
