Hello everyone,
I really need helps to figure out how to move canada from USA. My current status in US is no more though I entered here in 2014 as legal F-1 visa but didn’t join college due to some reason. I don’t have any criminal record here. Not looking forward to move Canada. I am in long distance relationship, She just got Canada PR. Now we both looking forward to settle in canada, and get married. What should we do. Should i go back to my home country and get married, or Can i stay here and get married with here so she can sponsor me. Does my status here in US make any trouble for sponsorship file? Is it possible to stay here in US and get sponsors from her, or Shall I go home country and do process? Is there any chance that i could be rejected and they don’t let me come in with spouses ?

You can get married either in the U.S. or in your home country. It doesn't really matter. Based on your other post, it looks like you are originally from India. If that's the case, you should make sure that your marriage follows traditions.

Once you are married, your partner can sponsor you for PR. She will need to be living in Canada when she applies to sponsor you and will also need to continue living in Canada while the application is being processed. Normally these applications take around 12 months. However you should probably expect longer processing times due to COVID-19 and also because they may examine your relationship more closely given your status in the U.S. When you apply, make sure you are 100% honest about your U.S. immigration history. You could also go back home. It's really your call. There is always some chance you may be rejected if they don't believe the relationship is genuine. You will wan to submit evidence to prove the relationship is real.

Note that once you leave the U.S., you will be banned from re-entering for 10 years due to your overstay.

That’s true. But I’m just worried about my status in US . Will canada immigration reject my file because of my status? During this process, Can she travel US to spend time with me?

No - Canada won't reject the application automatically based on your status. However you can expect the application to be reviewed more closely to ensure the relationship is genuine.

She can come and visit you. But needs to keep these trips short (3 weeks or less) and not do them too often. She needs to be living in Canada to qualify to sponsor you.
