Hi All,

So I am currently in the process of moving to Canada from the US. I am a born Canadian Citizen. My wife is a US citizen, and our daughter was born in the US as well. We are applying to get our daughter Canadian Citizenship, but also currently applying for me to sponsor my wife through an outland family-class application, since I am currently under the gun to move and start working in August.

My question is, for the purpose of the IMM008 and the IMM5481 (and others), do we consider my daughter a Canadian Citizen, assuming she will be approved. Moreover, should we consider our daughter a dependent child of my wives, or exclude her altogether as if she were already a Canadian Citizen? Will we face issues with this driving across the border if the paperwork has already been filed?

Can anyone here steer me in the right direction with this question? Thanks so much in advance.

If your child does not have a certificate of citizenship (which you apply for and takes about 12-15 months to get) then she is NOT a Canadian citizen. Hope this helps!

This depends on WHEN the child was born. It's possible that she IS in fact a Canadian Citizen, since her father is a born Canadian citizen. If so, she would only need to get her papers that confirm this.

I believe there was a change in the citizenship law ~ 2009, but...don't quote me on that!

Thank you both for the response. So just to clarify, we should include her on the forms? Or apply for her Canadian citizenship papers, then file the sponsorship application once it's been confirmed that CIC has received the citizenship app?

Since the OP states that he was born in Canada, his daughter is in fact a Canadian citizen already.

I hate to even suggest this, but the OP should call CIC to get answers on whether or not to include her as a dependent child for his wife. It would seem logical that the answer is no, but....

The answer is the child should NOT be included in the application, as she is a Canadian. They should apply for proof of citizenship. http://www.cic.gc.ca/english/citizenship/proof.asp

Agreed. The child is Canadian, regardless of whether they have the proof yet, and should not be included. The last person that included their Canadian child as a dependent had their app delayed for months.

There is no need to wait until after you've submitted your child's citizenship app to file the sponsorship app. The apps are completely independent of each other.

Does the processing time change whether you apply the proof of citizenship inside or outside of Canada? My wife recently received her COPR and will be landing on August 1st, then returning to the US where she'll give birth in September. At this point, we are deciding whether to apply for the proof of citizenship when we move back to Canada or while in the US.

Similar boat.

I'm a born Canadian, my son was born in the US - as far as Canada was concerned he was a citizen at birth regardless of if we had a certificate: We could use his birth certificate plus my proof of citizenship to establish the relationship according to the nearest consulate staff.

We did want a citizenship certificate as a travel document for entering Canada, just in case.
When we submitted the application for it, we requested urgent processing citing the need to use it as such for our impending move to Canada, and the processing office had the application approved and the certificate mailed to us within 2 weeks...

Did you then enter Canada only with the citizenship certificate of the child or a passport was required? Was the certificate sent to your US address?

it is my understanding a passport in not required for babies. birth certificates can be used to prove relationship.

We flew in; He had a US passport for that part since the airline wouldn't accept anything else. For clearing immigration we used his citizenship certificate, but his birth certificate along with my citizenship proof would have been enough - we just had to establish he was my child and I was indeed a citizen myself.

We were well over-documented, and the CBSA officer spent maybe all of a second glancing at his certificate.

It was mailed to our US address.
