Good Day House,

Please am currently in a big Mess, I applied for my Canada study permit application through a consultant in my home country unfortunately, they were not IRCC Regulated,

I sent them all my genuine documents etc and complete and honest information, and I later joined forums which enlightens me more on visa application process, so I ordered my GCMS file from CBSA to check the status of my application, My visa has been approved and stamped,

A month after my approval, my CBSA file arrived and I was shocked to see that the consultant had uploaded fake certificate, employment history etc on my application without my consent.

Please note that No PFL was issued, Visa has been issued but I do not plan to live and enter Canada on a lie, what are my options, can I proceed to to withdraw the application after approval and explain myself to IRCC? or should I just forget Canada and try other countries making sure I am in charge of my application henceforth

That's really sad. I would suggest you to talk to your agent about this and move accordingly
I have filed a police report and petition against them in my Home Country as they deceived and scammed me, however I need people's opinion if IRCC will look at my case with compassion

I intend to withdraw and cancel this current visa and reapply for a new study permit

That's a tough decision. One one hand your intentions are right, and you are a genuine student, so you must go to Canada. Other hand, you feel bad for misrepresentation. I would personally suggest you not to withdraw/cancel citing misrepresentation, as they might not take your case with leniency. Rest upto you

You should talk to an experienced immigration attorney. But as far as I know, your best bet would be to take a proactive stance on this by informing IRCC on a timely manner (ASAP) about your unlicensed agent falsifying your documents in the approved study permit application. Be honest and truthful as much as you can. According to the most recent case law in regard to Karamjeet Kaur whose agent also submitted a fake LOA (https://immigrationnewscanada.ca/karamjeet-kaur-canada-immigration-case-all-you-need-to-know/), she was found to have misrepresented because she did not even take any proactive stance to rectify the falsified LOA issue. If you act now, IRCC will view you with huge positivity and as a genuine student who always remains truthful and always takes necessary steps to ensure that the information submitted remains absolutely truthful, complete and accurate. Then later down the road, your future petitions for immigration benefits will not be hugely impacted by this. But go and talk to an experienced attorney about how you would go around this. As far as I know, if you are issued a PFL, you're already to be facing harsh consequences from IRCC with little escape since the IRCC will have already had suspicion of you misrepresenting yourself. I do believe that things will be different if you take a proactive stance and truthfully inform IRCC at the first place. Either way, you can't change the past. But going forward, you can set things right. Now is the time to act.

As far as I know, if you are issued a PFL, you're already to be facing harsh consequences from IRCC with little escape since the IRCC will have already had suspicion of you misrepresenting yourself. Has there been a decision made on your application? Your best bet is to contact IRCC and ask them if you can withdraw your application due to you discovering misrepresentation caused by your agent. Sooner you act the better, if you delay in actioning then you will be held complicit in deception

Thank you, Yes a Decision has been made, Application has been approved and visa counterfoil issued

I am working on contacting IRCC and explaining my situation ASAP and requesting a withdrawal

IRCC was right in removing someone who despite knowing never rectified.

Lol, she even tried to pull the victim card claiming her disability limited her ability to contact the college. Here's what the courts said:

Definitely agree with you on this. She was seemingly aware of pretty much what was going on and even played along with those wrongful acts.

Not being able to get in touch with the college was so intentionally wrong on her part that later down the road, things were already too late to be fixed.
