We did get married in San Miguel because this is where his mother and family is living my mother came to the wedding but that was it, my sister was in Florida at the time we did and I didn't want my father to come over because it is a too dangerous country for that I believe and when I did live there I have been very sick due to the water...so to expose my family to all the risks + lots of chances of being sick....Naaaaaah.

You said that your husband has been deported but how did he came to Canada ? was he here legally ? mine never came, he did claim the status of refugee at the border in 2010 and was refuse entry...I did meet him in the USA

You are lucky not to have to deal with the ARC! It adds time, stress and expense! It stands for Authorization to Return to Canada - ARC. Basically, my husband was in Canada and made an unsuccessful refugee claim (which is when we met, he was in Canada for 3 years). So, he was deported from Canada. A deportation means he is banned from Canada for life, unless he gets special authorization...the ARC. It costs $400 and once they determine our relationship is genuine, we will get the request. We then have to give our reasons why he should be allowed to come back to Canada.

When your husband wasn't allowed in Canada, was he given any type of order (there are three kinds, departure, exclusion and deportation), or was he voluntarily allowed to leave?

My mom was so anxious to go too. We brought lots of bottles of pepto bismal and stayed only in safe areas. Thankfully, everything went well! ES is such a beautiful country! It is too bad it is so dangerous.

he was given an exclusion...wich means that he wasn't allowed to be in Canada for a year, so from august 11th 2010 til august 11th 2011 he wasn't allowed to be in my country simply because he did show up at the frontiere and was denie entry and the status of refugee...wich correspond to the time I was pregnant.

My husband did not get deported because he was having an appointement with the USA immigration in november 2010..so he got his sentence of exclusion and right after they did remit him to the other custom ( US border )...

the visa section in Mexico did not ask us the ARC document so far...do you believe that the could ask us something like that since my husband was exclude ( bannish ) for a year to come over ?

so what you are telling me is that your husband never had any status while he was here ? is that it ? cause if it's the case I simply wonder how do they treat situation like that for either a no status in Canada or the USA ? any idea ?

Your husband won't need an ARC as his ban from Canada was only for a year. And as you say, that time has already expired. He doesn't need the special permission to come back anymore. Which is good for you. Maybe they thought he was going to live here with you?

Status when my hubby was here - All refugee claimants are given a departure order and told that if their refugee claim is negative, they have to leave Canada within 30 days or the departure order becomes a deportation order - a lifetime ban from Canada.

After his negative refugee decision, my husband stayed in Canada to appeal his case and to apply for a pre-removal risk assessment (another process). Neither was successful. So, he had status during those processes, but because he stayed after the RPD decision to appeal, his order turned into a deportation order. Weird system if you ask me.

What's is your timeline? Hopefully you are at the end now! Have you ordered your case note?

Yes that's probably what they thought cause he did give my name at the frontiere because I did ask him to join me here..so he show up there, told his story ( in a process of divorcing his american wife ) told them that we were in love and claim the refugee status so he could join me and was simply refuse and almost kick in the ass !!! lol

I guess they refused him this status simply because he did give my name ? so you think it's the case ?

Also we did not ask the note yet..according to my lawyer past summer in was too early, he doesn't really want to ask them til the decison is made because we cannot ask them more than once..so if we are refuse for his PR we will ask all notes and if possible contest the decison...but I really hope we won't have to do that..it has been such a difficult road so far..we suffered al lot already as a couple but mostly as a family, I'm sure you suffer too, I can imagine how harsh it was to tell him good bye here in Canada...

Your lawyer has given you inaccurate information. There is no limit on the amount of times you can request your case notes. Some people in this forum request them once a month, just to stay on top of their file. I have my second request in already. The first one didn't show too much, it was early on. Should have the second one soon (it takes 30 days). And you don't need your lawyer to do it for you, you can request it yourself. Just look through the posts on here, people have given detailed instructions how to do it. I think it will give you a great insight into why your file is taking so long.

Each goodbye has been very painful. Especially that first one when he left Canada. I am so tired of these goodbyes. I want my big, forever hello!!! As you do too, I am sure.

I'm surprise to hear that..I really thought that the note book were were giving only once to the sponsor..isn't it according to the law of : access to information ? that's what my lawyer told me and I did call to cic a few months ago and was told the same..but I don't know for you but I did notice that from each time I was calling the customer service center I was told a different story..looks like there is confusion there...lol

what I know for sure is that while you request your personal note from your file at the visa office it then means that your file is getting put on hold for a 30 days and that the agent assign to it can no more work on it..my lawyer told me that they do not appreciate those request b/c it means from someone else to come to stick their nose into their business..

were you aware of this ? is anyone mention this before ?

I have always wanted to go Montreal! It is high on my list of places to visit. Too bad airfare within Canada is so expensive! One day I will visit.

I have never heard of what you mention. When one makes a privacy request, the actual physical file is not touched at all. Someone in Ottawa accesses the electronic file and sends you a copy of that. It contains the notes from GCMS. I don't see how it would delay the processing. And I don't think it makes a difference to the visa officer. They will make their decision based on the facts of the relationship, not on making ATIP requests.

I have heard that making case specific enquiries to the VO can cause delays. That is when they have to pull the physical file.

Can anyone else reading this weigh in? Does making ATIP requests delay the processing of the file?

Cici I have to tell you the big news...WE GOT APPROVED !!!! my husband got an e-mail today from Mexico where they are requesting his passport to be ship within the next 2 weeks to the visa section in Mexico

I'M SOOOOOOOOOOOOOOOOOOOO HAPPY !!!! GOOD LORD WE DESERVE THIS !!!

Just read what you wrote about notes, and I am sorry to say this but you should get yourself a new lawyer....I have never heard such a ridiculous thing...ordering GCMS notes does NOT interfere with your file, you are entitled to know what is going on. I have ordered it every month and will continue doing so, and really nothing has changed about speed or delays! Barbarita, there are many seniors on this forum, and I can assure you that they will give you the same response, NO interference with your timeline whatsoever.

I am sorry that he is misleading you, maybe he was talking about something else.

Thank you for the comment..I appreciate and I may totally be wrong on this and my lawyer may have confuse me or maybe I did not get it right..I will clarify this situation with him once he is back from Perou...and I will found out if there is a protocole about getting your note and if I was wrong I will post on it cause I don't want to mislead or confuse anyone...

maybe it depends of the situation..but you know at the end what matters is for my husband to join me in Montreal and we got approve today without me requesting the note of our file each and every month..don't get me wrong here...I'm not saying that it is the right way to do so but from my personal opinion I don't believe that it's necessary to show to the visa section how insecure and anxious the sponsor and applicant is...don't you think that in some ways it's better to show that you trust your file and to trust them too ? it's just my opinion..I'm sure not every one shares it and I respect that

in any case I cannot change what did happen..I'm just happy for the great news we got today and I wish you the best !

my husband is so excited and I'm excited too....but I cannot not think of you and all of the other application pending..I hope you get a positive answer soon too...be patient and trust yourself..what is meant to happen will happen..
