I am an Australian citizen. Is it possible to change vo after it has already been submitted for spousal approval?

Originally came to Canada on an open work permit. If that helps.

Your help has been greatly appreciated. Kinda worried that's all.

LOL. I think I actually have more questions about your situation than you do. I have not been able to find out any reason why you could not extend your work permit while your Fam Class application is pending.

When you say changing VO's do you mean Inland/Outland or Sydney/London?

Appearances can be deceiving. Australia has PRs as well and they work the same as Canada. They hold their passport in a different country, which may require a visa. Just like how a Canadian PR may still have to apply for a Visitor's Visa for the USA.

Good point. I think an expat British citizen can be a dual citizen in OZ. If that's the case they may only have the UK passport. Would that then require them to have to go through London as a VO?

I'm probably making it more difficult for myself. How should I go about applying for the extension. Do I put in the application that I am applying for pr through the family class.

I was thinking inbound to out bound.

Also, if I was to get it to outbound eg Sydney, would I have to travel to Sydney for the interview if it was required? I've noticed a lot if people have had the interview waived. Is it just random or depends on each case.

Sorry for all the questions.

What do you mean by Open Work Permit? Do you mean the working holiday visa (IEC)? We need to know the conditions of how/why you got the OWP in order to understand your situation.

It's really not possible to change the VO from Inland to Outland or vice versa because the forms aren't the same. If you want to change from Vegreville to Sydney (or vice versa) you would have to withdraw your entire application and re-do it. That might entail re-doing police clearances (but probably no need to re-do the medical). Of course, you would have to fill out new forms as well. Basically, Inland implies you live together whereas Outland doesn't - it gives you the option to say you do, but it's not guaranteed.

Let us know about the work permit. And like I said, worse case scenario, you change your status to visitor for the duration of your application. You can't work, which sucks, but you could take a 6 month certification course at your local college without needing a study permit... if you're interested! (I study to pass my time, as I'm a visitor waiting my PR inside Canada, but applied Outland - so no work permit for me!)

If you're applying Inland currently, you can submit the application for an OWP right away. Just make sure you reference your information (UCI, file number, name, DOB, etc) so CIC can figure it out. There's a chance they won't even if you do it right.

Yes, if you apply to Sydney and you require an interview, you will have to go to Sydney. The good news is few couples from visa exempt countries get interviewed. So it's a gamble - but a small one. I'm American and if you look at our spreadsheet (Ottawa, in my signature. Why our VO is Ottawa, I don't know.) only 1-2 people required an interview. One is gsize, who originally went through Mexico City - long story short, he was transferred to Ottawa to avoid bias at the Mexico VO. (I'm saying he really doesn't count towards our interviews! His interview was at Mexico City VO.) If your application has sufficient proof of a genuine relationship, you shouldn't worry too much. It sounds like you've lived together in Canada, so if you included that proof - well, there isn't much better than living together and having interdependant lives, sharing bank accounts, etc.

Basically, interviews are reserved for when the VO isn't certain the relationship is genuine.

I can't tell you about the extension until I know how you got the OWP. ;)

If you haven't sent the application yet, I would definitely suggest going outland. Don't use my timeline as a guide, Sydney is really quick if your application is straight forward. Outland has no residency requirement, you can appeal if denied and as has been mentioned, the chances of an interview are slim.

an option that may buy you a few months (depending on the work permit processing times) is to apply for a work permit extension just before your current work permit expires (you can apply on your own, you don't need employer to apply, your employer only applies for LMO not the work permit and use the paper application), once applied and paid the fees you will automatically be in the implied status which entitles you to continue working your current job. Now when the application reaches processing and they find no positive LMO they will likely deny the extension but processing times can be as long as 4 months (currently they are working on January 2013 applications for the paper applications)

I decided to go outland and returned to Australia (it really came down to $ as we couldn't afford for me to be off work if we did inland).
Our processing time was 4 months - including the time it took me to land (as I had to resign my job in Australia and work out my notice period). So long as you can put in a good application (and it's complete - you don't want to get bogged down by having to resubmit or add new information) you could be surprised by how quickly it is processed - for me the biggest wait was getting my sponsor approved -once the application got to Sydney I was approved in a matter of days ...

1. Look folks the guy is an Australia.
2. Looks like he came to Canada on an IEC/BUNAC open work permit.
3. There is nothing stopping him from apply for another IEC as long as he is under 30, so he should explore that option.

I came to Canada on an IEC open work permit and it allowed me to work for any employer. Im only 25 so age isn't really an issue.

We have lived in Canada together for 1.5 years already and lived together in New Zealand for a 1 yr before coming to Canada.

Okay then apply for a new one. Same as before. Just make sure you have it before the old one expires OR you take time off work between. IECs aren't extendable and there is no "Implied Status."

Yes, this is a valid option. Implied status applies for extension applications even if they are ultimately denied. (I did this on the advice of an immigration attorney with no problems to bridge between a Working Holiday permit and a employer sponsored permit). If you are changing status, such as from work permit to visitor, it does not apply. I even got the application fee for the extension refunded because my new work permit was processed just before they got to the extension application!

But if you can get a second term on the working holiday program, go for that! As a kiwi I was mightily annoyed that you Aussies can apply for a second term and we kiwis can't!

Thank you PMM for your suggestion.

it looks like applying for another IEC option is possible. i spoke to people at their office and they said there should be no problems there. the only issue is that i can only apply 12weeks before my current visa runs out. Fingers Crossed this will work. This will also make the inbound outbound issue easier as well.

thank you for everyone else for you suggestions as well. please tell me if you know this wont work.
