Hi,

Ive just submitted my application to be sponsored here in Canada by a Canadian Citizen, and by the processing times on the CIC website and it looks like I am not going to get an answer before my current work visa runs out at the beginning of Nov 2013. Will i have to leave the country and go home (Aus and wait for it to come thorough (hopefully). I work here in Canada in a retail store as a store manager. Do i have any options or will i be needing to go home?

Im sure i have left out of some info but just let me know if anything would help.

Is it a spousal sponsorship? Have you applied for an extension to your work visa?

yes it is a spousal sponsorship.

Ive not been told anything about being able to apply for an extension. i looked at the extend you visa part on the CIC website and my employer will not sponsor me to extend my visa so i dint think i could go down that route. Is there another way?

First. It might be a good idea to get yourself in the habit of referring to your spouse/partner as your spouse/partner and not as a Canadian citizen.

From what I understand is once the application for spousal sponsorship has been submitted you have "implied status". So although you can no longer work beyond the visa term you would be able to stay until the application has either been accepted or declined.

Are you on a temp work visa or have you been sponsored by your employer?

I am currently on a temp work visa. i was hoping not to have to rely on my partner while i didn't work as by the looks of the processing times it could well be for a long period of time.

Also, is it possible to apply for both the the Family class as well as Canadian Experience Class (CEC). The reason is because they have the bridging visa option i could possibly go through.

It will be a long time that is for sure.

If you have a temp work visa you do not need your current employer to endorse and extension.

If you are in a legitimate relationship than I would go the spousal sponsorship route. You can do it outland even though you remain in Canada.

Just a correction, implied status is only a) Inland or b ) for visitor's visa extension.

Are you going through Sydney VO? They're fast. If you have a straightforward application, you could be done as soon as 4 months. In October, if there's no answer, apply to change your status to visitor. You will have to stop working on the expiry date of your work permit, but you can stay in Canada until you get a decision made on the visitor extension or pr app.

Are you Australian? Holding a Aussie passport? Please let us know so we can give you better advice.

Thanks for correction. I thought I had read that applied to work permits as well. My mistake.

Not so. If the original work permit was issued on the basis of an LMO, then a new LMO will be needed (and hence employer support will be needed) in order to get a new or extended work permit.

Would that not fall under FSW? He has only a general temp work permit. No special skills to be a retail Manager.

He's already got a PR application in process. If he's Australian, he will most likely be allowed to stay as a visitor if nothing else. It's important we find out what citizenship he has and which VO he's applied through. Sydney takes only 9 months (at the 80%) mark.

By his first post it would appear he is an Aussie.

Would he not be allowed to extend his work visa even with a Fam Class application submitted? Would one have to be surrendered to allow the other to be processed?
