Hello!

I've been reading a lot of information on this forum, its really helpful, thank you guys!

I'm brazilian, my wife is canadian, married here in brazil in december 17th. I have a single entrance temporary resident visa, and we are moving to Canada on Feb 2nd to Fredericton, NB, and after 2 or 3 months we are moving to Ottawa. We plan to apply for sponsorship inside Canada. I dont plan to come back to Brazil in the next 2 years, but I would like to visit US (I have the US visa) sometimes.

My visa gives me 6 months to stay there. We plan to apply for sponsorship once we get there. On the Citizenship and Immigration Canada Website, they say:

Inside Canada

* average of 12 to 18 months to process routine applications
* no right of appeal
* you are advised to stay in Canada while your application is being processed (If you leave Canada and cannot re-enter, the application will be abandoned)
* you can send an application for an open work permit with the sponsorship application (the permit will be issued as soon as you are eligible for it)

With that said, here is my doubt:

1) Once we get to Canada, we will apply for the sponsorship in 1 or 2 months. After applying, what's gonna happen to my temporary resident visa after it expires in 6 months? Do I need to extend it? How? Or will I need to leave the country? Do they give me this extension for sure, cos i applied to be sponsored? Can this extension be a multiple entrance temporary resident visa?

2) "you are advised to stay in Canada while your application is being processed (If you leave Canada and cannot re-enter, the application will be abandoned)". This is not clear. If i get a multiple entrance temporary resident visa, and i still have time to stay there, can i leave and re-enter? Makes no sense they deny my entrance again just because i applied for sponsorship there, so, i think i didnt get it.

3) What if i get a job there, and the employer wants to give me a work permit, can i get it? (or, do you RECOMMEND it?)

Oh, one more question.

I read that in buffalo, the processing time of the entire package is 11 months. Can I apply there (outland) since I'm brazilian and i have US visa?
If I can, it makes sense, because i would have to wait 11 months inland to get a open work permit anyway!

Even if you are in Canada, you can apply outland to Brazil. You can do everything you need from Canada, including your medical, and still apply for outland sponsorship which means a faster processing time, and you are able to leave and come back to Canada as long as you have a multiple entry visa. Since you don't, and if you cannot obtain one, you can extend your visitor visa that you have before it expires (I believe you have to do it before 5 months, but I would do it before, just to be safe) and maintain legal status in Canada.

I'll try to answer what I know.

Outland is generally faster (and São Paulo is listed as 10 months). Since you are Brazilian, if you would like to apply outland, you should apply through there. Unless you have US citizenship, I dont see how you could apply outland through Buffalo (not totally).

You can apply outland even if you are in Canada. Coming in and out of Canada is risky, specially with Inland as your application could be totally cancelled. Even with a multiple entry, once they know that you have applied for permanent visa, they may refuse re-entry. A visa is not a right, its a permission at each time you cross the border.

About the visitor visa extension, once you are in Canada and have an application filed, you can extend the visa.

Yeah to be honest I don't think you have much of a chance of being denied. I am pretty sure you can also change your visa status (though I am not sure if you can go to single entry to multiple entry, I know you can apply to change it to a study, or work visa)

If you apply inland, you can send an open work permit application and once your sponsor is approved you can start working, but you should NOT leave the country until you have a decision because they may deny re-entry. It's a risky thing as no one tells you why they would.

If you apply outland, the advantage is that you can leave and come back, and you also have a right of appeal, however, I would try to find out if they would renew a visitor visa, as I've seen time and time again on this forum people who have been denied the visitor visa.

Perhaps you can get a student permit, or find an employer now, but it may be a bit last minute.

I would advise the Outland anyway because Brazil has a good track record on refusals (only 2%), and they seem to process the cases somewhat fast, especially if the file has no dependants or previous marriages, and it is well organized.

I was reading more info, looks like its better to apply outland, but i'm scared of having to leave canada when my tourist visa expires :(

Dont know what to do.

Once i step inside canada, can i change my single entrance visa to a multiple entrance visa there?

Thanks for all your replies! I finally arrived in canada. The visa officer didnt stamp my passport with a date, which means i have 6 months to stay here, according to the canadian immigration website. So, I can stay here until August 4th.

leroadrunner, since you are brazilian and lives in canada, while applying outland, I think we are in the same situation :)
I entered the country with a tourist visa. Right now I am in Fredericton, and maybe we will be moving to halifax until september, when we need to go to Ottawa cos my wife will start school (she is canadian).
After reading about it, we decided to try to apply outland.
Before leaving Brazil, i went through all the medical exams, since i had a health insurance plan, to save some money! So, the clinic in brazil has my exams there, waiting for me to tell them to send it.
Im a bit confuse with this Outland procedure. After gathering all documents, filling all forms, do i need to send it to são paulo or somewhere else??
I know i will have to apply for a visa extension. Is it difficult to get? Should i send it with the sponsorship application to wherever i need to send it?
One more question: since im moving around, first to halifax, then ottawa, but now im in fredericton, is there any difference in the process? I have a permanent address here in Fredericton and in Halifax, but in ottawa we would have to rent a place, so i cant give any ottawa address in the application.

Sorry, but as you can see, im full of doubts, and we are scared to have to be apart while we wait to this whole process.

Hi there,

You can extend your visitor's visa at no later than a month before it's due to expire. You can extend for an extra 6 months. I have done this twice now so that I can remain in Canada while my outland PR application is processing. It hasn't been an issue for me at all.

What did you add to your visa extension application? Did you tell them in the application that you are waiting for the PR that was made outland?

Your application goes to the Case Processing Centre in Mississauga where your wife will be approved to sponsor you. CPC-M will then forward it to Sao Paolo, where you will need to go if you have an interview.
