Hello,

I filed for sponsorship (for my wife) in August 2012.
Then we submit her passport following a request in June 2013.
She was asked to redo her medical in October 2013. She did it right away.

Is that normal that they request her passport 8 months ago ?
Am I still in the normal delay or should I contact my MP ?

You have far more patience than I would have...no..its not normal..even if there were extraordinary circumstances relating to your file.

When you submitted your app the timeline for processing would have been less than 12 months..

Have you ever ordered your case notes? Even not knowing the circumstances of your file...your timeline is way out of wack...

I agree it should have been less than twelve months.

I received my PPR in march 2013 and only surrender it in June 2013 because we (Me, Wife and Baby) came to Canada for three months.
The sad part is that my tourist visa request took 5 months to process and I end up not being able to come for Christmas as I had planned originally.

My file has no special issue.
My wife has no criminal record and has no health problem.
We had a baby in January 2012. He is now a Canadian citizen (Feb 2013).
I live in Philippines almost 2 years with my wife.
I am in Canada since March 2013 and provide a proof then of my relocation Plan. (Request for more information that Came in March 2013 with PPR).

I thought the delay was because of the strike and typhoons.

To request my file I have to go to my MP ?

Once I see my file can I really do something about it ?

Definitely contact your MP. Yours is one of the few now older than mine. 80% of the spousal applications in Manila are completed in 13 months or less according to their own stats. That puts ours in the bottom 20% - absolutely unacceptable. I just ordered my case notes (should have done it a long time ago) and will be contacting the case manager in Manila in the next few days. Finally if there is no immediate resolution I will contact the Case Management Branch in Ottawa to review the handling of my file. That's the last step before hiring a lawyer to sue for case resolution.

The fact that you got married means more than your chat logs. The only thing they establish are the length of time you have been in contact and if you speak to each other like spouses do. That matters if you applied common law or conjugal. Not so much once you get married.

CanadianJeepGuy, I very much hope you are right. But I think the burden of proof is more than just showing how long you have been in contact. If CIC thinks, "Well, the fact that you got married means more than chat logs" then we would not worry about that burden of proof. In our society, you are innocent until proven guilty. However, in the world of CIC, you are lier and your relationship is a sham until you prove otherwise. Why do they assume that? Because people have gotten into fake marriages in order to get permanent residency. Sad but true.

Yes. You are right about the burden of proof is on the applicants. So the proof that is required is given by CIC. The quality of proof is what is most important. So legal documents supporting your claim of partnership carry the most weight followed by financial records, travel receipts, photos, testimonials and such. The less you have of these then the additional things like chat logs can be helpful.

Well, after 16 months and 8 days my Ecas finally changed to DM last night! I made a joke in another thread that hopefully yesterday's maintenance included some DM's, ha ha.
This past 2 weeks I have ordered my case notes, complained to my MP twice, sent a case specific enquiry to Manila and wrote a scathing letter to Chris Alexander. Not sure if any of that helped and I guess I'll never know.
Now just have to wait for the decision letter and hopefully the COPR.
