LMO in progress - questions

Hi All,

I have an LMO in progress and I had expected it to be complete by now, my problem is that I am booked to fly to Canada in a week and I'm due to attend a few meetings very soon after I arrive (see: it would be difficult for me to change my flights).

If I were to enter Canada on a tourist visa prior to my LMO coming through, would I need to leave the country and re-enter in order to then apply for my work permit?

My partner will be following me a few weeks after I arrive in Canada, will she be able to apply for her open WP at the port of entry without my being present?

On the application for WP (IMM1295), question 9 asks the country where applying - I have put down Canada as I'll be applying when I arrive, but should the dates be the date of my entry followed by the date 2 years later?

Do you need a visa to enter Canada? If you do, you would have to send your application to a visa office outside Canada, the US usually. You can then exit and enter to the closest border where you'd be staying, once the WP/visa gets approved. The catch here is if you'd be called for an interview, you should have a visa to enter the US.

I'm from Australia and I don't have a criminal record or any medical problems, so my understanding is that, once my LMO comes through that I'll be able to apply for the WP at the border and get in - is this correct?

How about the other questions?

No worries then. Do a flagpole and obtain your WP once you get your LMO (if you're in Canada).

Here's my situation at the moment:
I am a contractor and I'm currently being paid to my business here in Australia. If I'm there prior to the LMO coming through then I'll still be paid to my business here in Australia - are there legal issues there?

The alternative would be that I wouldn't be paid at all until the LMO came through.

One of the experts here might be able to shed some light on this.

Having been through the process before, I'd be twitchy about doing anything that the Immigration Officer might have a dim view when you turn up at the Port of Entry asking for a work permit. Even with an LMO, they can refuse your permit if there is anything they don't like the look of. It might be just me being paranoid, but I'd avoid doing anything work-related in Canada before obtaining a work permit.

To be safe, do you have the facilities to do a video-conference rather than attending the meetings in person?

I asked my company a similar question and they were advised by the immigration lawyers who did my paperwork not to come to Canada without the LMO. They called it information basis and not work permit basis and even if I did come over I couldnt open up bank accounts,apply for SINs, put my kids in school etc without the work visa.

The advice they gave me was to wait for the LMO
