LMIA - SOUS CHEF/COOK

Hi all,

I am wandering if someone can help me. My partner is working as a sous chef in a kitchen, with no qualifications, only experience. He is looking to apply for a LMIA however according to NOC a sous chef needs a cooks trade certification as employment requirements (which he doesn't have) is there any way around this or is it better he just applies under a cook? His work want him as a sous chef however is it simpler to apply under a cook for LMIA purposes? The duties are very similar the only main difference is that he doesn't need any qualifications as a cook.

Yes i understand that, they are unsure of the process and obviously if he hasn't got qualifications to back up the LMIA for a sous chef it makes sense they advertise the job and apply under cook? Im just thinking once they get passed the advertising stage, he will have no chance if people applying are actual qualified sous chefs? I hope this makes sense?

Ok, if the job was advertised as sous chef (and does require a certification or equivalent credential), then all candidates without certification would be ineligible.
So I would guess that for him to get the job, it must be advertised as cook.

Ok that make sense, if we want a more likely chance at getting a positive LMIA what if we say they need a cook with sous chef experience or would that not match LMIA anymore? Can we include actual sous chef duties as requirements or will that then not match the noc code requirements of being a cook therefore complicate things? Even if this means potentially less people apply for the job

Job duties have to match the NOC.
