LMIA in municipal government

Hi guys, i work in IT for municipal government in Elmira, Canada. My job falls under high paying jobs and my work permit expires on Jan 2025. I was thinking to ask my director of department for LMIA, but someone told me government do not allow or provide LMIA. So how true is that?

Moreover, LMIA is approved based on unemployment rate of the area you for, i work in elmira- ON. So how do i check if my area falls under high unemployment rate?

Note that- i was hired for 18 months initially then i was already promised that i will get permanent job once contract ends. Since OINP doesn’t not support contract job, i had asked them to break the contract before 18 months and offer me permanent job, which they did. But not sure if they can allow Lmia!!

Thanks in advance- if you can answer these two things.

What country are you from? Are you eligible for OINP now and is municipality even eligible? They need to meet certain revenue targets, as an example. And they need to support your nomination with mandatory forms. NOC and OINP score selected?

Governments rarely apply for LMIAs. If you have been there that long they will have to restart the hiring process from scratch to show that no Canadian or PR can do the job. So they need to start ASAP as they need to post the job for at least a month. So talk to HR. Also FYI - LMIAs applied in March are just being approved/refused now.

I am from India. I had asked them for my ONIP application. They were fine with it, but draw did not come for General category in international student stream.

I have not asked them about LMIA because its different beast. I am not sure if i should ask them about LMIA, so i thought i should ask you guys & double check online if municipal governments are even allowed to issue one.

Ask the municipality as they will need to meet LMIA employer requirements. They need to start the recruitment process from the beginning and post your job.

As for OINP, how is a government eligible?

Should it be internal or external posting?

- I am not sure how government could be eligible for ONIP, but they told me they would fill up any forms related to ONIP if i get invitation for PNP. They were pretty confident and supportive about it

For them to apply for a LMIA, they have to prove that no Canadian or PR can do the job, so external posting. They document the recruitment process and then pay $1k and file for the LMIA.

Did you read the link? Just because they support you doesn’t mean they are eligible.

General requirements
To qualify under the Employer Job Offer: International Student stream, your employer must:

  • have been in active business for at least three years prior to submitting your application
  • have business premises in Ontario where you will work
  • have no outstanding orders made against them under the Ontario Employment Standards Act, 2000 or the Occupational Health and Safety Act
2. Revenue requirements
Your employer’s business must meet one of the relevant revenue requirement for the most recently completed fiscal year (the year used for tax or accounting purposes):

  • a minimum of $1,000,000 in total gross annual revenue if you will work or report to work at a location in the Greater Toronto Area (City of Toronto, Durham, Halton, York and Peel regions) or
  • a minimum of $500,000 in total gross annual revenue if you will work or report to work at a location outside the Greater Toronto Area
