Hi Everyone,
Im from NZ and my Partner (Common Law) is from Canada. We are currently in NZ and are wanting to move back to Canada. We need to apply for spousal sponsorship but now we have hit a speed bump in regards to the LMIA process.

Labour Market Impact Assessment exemption code: A70
This exemption applies to the following persons:
2. members of the spouse or common-law partner class who have satisfied an officer that they meet the requirements of R124;

R124 A foreign national is a member of the spouse or common-law partner in Canada class if they
• (a) are the spouse or common-law partner of a sponsor and cohabit with that sponsor in Canada;
• (b) have temporary resident status in Canada; and
• (c) are the subject of a sponsorship application.

So my question is: am I (nz) exempt from an LIMA due to me being the common-law partner of a Canadian citizen, on a visitors visa, and will have a spousal sponsorship application processing from in Canada?
If this doesnt work then i will need to apply to work through the BCPNP.
Any help would be great!

Hi

If you come to Canada and apply inland, you can include an Open Work Permit app with the PR app. You would receive the OWP after about 4 months.

Note that NZ outland apps go to either Sydney or Ottawa and average 4-6 months, so you should seriously consider applying outland now.
