I am applying soon. I am good in time as my current WP is still valid until March 2016 but I have a different question. I came her in 2012 and my employer applied for LMO exemption which was confirmed. Now there is LMIA which is the new version of LMO. Does my employer have to apply again or is the LMO exemption still valid? Does anyone know that?

I applied for a WP extension with a LMIA exempt employer on June 2nd and still waiting (~60 days). I am guessing it will take 100 days :s. My WP already expired on June 30th but my understanding is that when this happens you fall into implied status until a decision is reached on the renewal. So nothing to worry about right? Does implied status expire?

yes, it will take 100 or more days.

You are under implied status until you get a result from CIC regarding your work permit application. You can work under implied status according to your previous expired work permit.

If your application is approved then nothing to worry about. But, if it gets rejected, then you will be out of status : you will have to apply to restore your status within 90 days (we can't work till we get our new work permit during restoration period)

I applied for study permit (change conditions from OWP to SP) and based on that, for my husband OWP (extension of OWP) on April 24th, 2015.

I've got my SP last Wednesday - July 29th...and we are still waiting to process my husband's WP.

my work permit expired last may 16 and i applied my wp extension before it expired so im in imlied status right now .and i just got my lmia last week,do i still need to process my new work permit with my positive lmia or wait for the decision of cic?

On what basis did you apply your work permit? Was it LMIA exempt with pnp support letter or any other category?

I have a question about a few things:

1. My extension application had a bit of a problem: i am at a centre at victoria university at the university of toronto and my work permit was fir uoft, so i applied for an extension with the same employer. But they introduced this new thing about employer id and fee. I had the centre pay the fee, but they did not have an employer id assigned yet, and u of t HR told me they cannor give me the uoft id brcause its vic wchich employs me, and vic dows not have an id either. I am worried that there might be a priblem with this id because my current permit did not distinguish between centres, departments etc but just said uoft. Should I expect problems? What do you think guys?

2. If (hopefully not!!) my application is rejected (i applied july 7th but permit expires september 30th), and my wp expired, what should i do to stay in canada? I am common law married and do not want to leave, wewant to apply for my pr in may. Would restoration of status be required? If so, what status should i try to restore, temporary redident? Can i apply for a new work permit with this employer? If so, do i do it after sttus has been restored? Or do i have to apply for a visitor visa? And do i do it immediately or do i have to wait with the new wp/visitor status for after status is restored?

Hi,

1. Don't worry about employer ID because if your employer is hiring a foreign applying for the new time under these new rules then you can just leave that column blank and CIC will assign an ID when they assess your file. So, there are no chances they will reject your file bcz of that.

2. First of all, I think your application won't be rejected if your employer has paid required fees and you have completed and uploaded all required documents. So, you will be under implied status till CIC gives you result of your application.

Even if CIC rejects your application due to some reasons then you can still work (after your current WP expires) under implied status till you get a decision (approval or rejection) on your application.
3. If your application will be rejected then you will be applying for restoration of your status (work permit) with your same or new employer.

CIC is taking 117 days to process work permit applications so definitely you will be under implied status after your current WP expires.

Are you from TRV exempt or required country? Do you have a valid TRV if you are from TRV required country?
