I just wanted to say that your situation is reversible. You can actually return from India to Canada. All you have to do is to present your PGWP application information at the port of entry (POE) to the officers on your return. You can print out the original PDF document that you received after submitting your PGWP application. It has your online application number that begins with a W and also have your UCI number on hand. The Officers will use those numbers to check out your application in the system. Once they confirm (usually), they will let you in. Remember your Implied Status allows you to stay in Canada as you wait for your application to me processed.

Your situation isn't a new one and lots of students who graduated and returned home for a vacation had to do the same. Good luck

I agree. This situation is so frustrating. Somebody mentions petition just now. I think that is a good idea but I don't know how. Anybody has any idea?

Hi,

Thank you for your information. I'm in Canada but my study permit and visa have both expired. I want to go to the border to flagpole my spousal open work permit (my husband is here) because I'm tired of waiting and cannot handle this pressure anymore. I called the call center agent, they told me that I cannot do a flagpole because my study permit and visa have already expired. I'll be departed from the border once I reach there. Is that true? Did they lie to me? If somebody without a permit and visa can actually return to Canada with implied status, I think I can also flagpole.

Jubear, this is only true if you are from a entry visa exempt country, correct?
Or does this also apply to countries that need an entry visa to enter Canada? I'm currently back in my home country for my wedding and I was told by the CIC agent that I need to apply for a TRV outside of Canada without a work permit, otherwise I won't be allowed back in Canada.

Either way, when I will check in at the airport, they will not allow me to board the airplane without a Canadian Visa - so I don't know how you can do this. Please assist. Thanks

It is true you can return. I have friends who have jumped through this hoop in addition to some on this forum. That's why I always advise people to check the PGWP forum pages. There is a tonne of invaluable info. The decision to enter Canada is solely in the hands of CBSA Officers not CIC call centre application agents. Hence why the CBSA check the system and let you in. However, one's experience will be entirely different from another's

Its a risk to take and has worked for some, but it might not work for you or others. Sometimes these things are all about the officer's mood. Its worth a try if you desperately want to return. But you don't have to.

I agree. I applied on May 11 and paid 100$ same month. They told me my application will be processed by end of last week. Now even moved to 16 May, my application is still in process according to automated message. I can not reach any agent on phone. The automatic message tells the same thing: "we are currently processing your application" - tired of it... :( :( :-\ :-X :-[ :mad: :mad:

Yes, the CIC agents were right. In order to apply for a PGWP whether online, paper application or FP @the border you need all documents including either a valid TRV or valid SP or a valid OCWP (Off-campus work permit - for those who still hold one for the old program).

You essentially earn implied status after you've applied for the PGWP online or paper
. So please don't head to the border. Usually you don't want to mention that you applied online already. The thing is, when you to go to FP, you are considered as someone applying for the first time and then they will ask for all valid documents. Implied status and FP are two different things. Technically you can only be on implied status during the few minutes of processing your PGWP at the border. Hopefully that clears the confusion.

I understand it's a risk to take but to my experience, airline staff doing the check-in at the airport will check my final destination and verify that I have an entry visa. If they don't see it, they will turn me away right away. Also since there's no direct flight from my country to Canada, if I'm able to get on a plane from my home country, at the transit destination, they will not allow me to board since they are going to check my visa again. So, I don't quite understand how this is possible but it's okay. I won't do this.

On another note,
I applied on May 13th as well and just call CIC. I was told that my file is under further review and this process is taking longer. The latest that I should receive my PGWP is December 9th - but there is a chance that I get it beforehand. If I don't get anything by December 9th, I should contact them again.
Still, in the worst case scenario, this is going to take 7+ months... *sigh

Also applied on May 13th and was told the same thing. I was told that because my file was "incomplete" meaning that I hadn't been actually asked for the $100, I would have to go through further review. It's so messed up. I wasn't even told a date to call back by, she just said that the normal processing time no longer applied to me.

Thank you for your reply. I have already applied my PGWP online May 3rd and paid $100 Aug 18th. So I've earned my implied status. I haven't yet got my PGWP and my boss has terminated my salaries. She tried to be nice and considerate to the best she could. She thought I would have got my PGWP no later than Aug and now she cannot handle the pressure of paying someone without a work permit or a SIN for almost half a year.

My husband has valid status in Canada. So I think spousal open work permit may be my last back up plan. You think there isn't even 50% that I can win this at the border? :'(

I planned to tell the border officer that "Although I understand my study permit and visa have already expired, I never stay in Canada illegally because I've earned my implied status by PGWP online application. So pls don't depart me. (I've printed out my application receipt and the CIC webpage about "implied status".) I'm also eligible for the spousal work permit. Although I have applied online for PGWP, spousal work permit will last longer and I cannot afford waiting online pls show sympathy..."

I know this is a high risk plan and there is a chance that I won't even be back once I reach the border. I'll finish up all the things I have to in Canada before I use this last resource. I'm just wondering did anybody try this before? Is there even a slight chance of success?

There is always a way. You and your spouse might be able to utilize the C41 of the R205 (c)(ii) rule under the immigration and refugee protection regulations.

Your spouse should make sure that his job NOC Code falls under skill Levels 0, A or B. For further info, please go here: http://www.cic.gc.ca/english/resources/tools/temp/work/opinion/policy.asp and then you and your spouse should start gathering documents. He should accompany you to the border as the principle foreign worker. Note that your SOWP application will be processed based on your husband's WP. He will also need documents from his employer. For your sake, always stay calm and collected while explaining your situation to the CBSA Officer. Depending on what border or province you are in, some applicants have been asked to show Health Insurance Card/info. So you and your husband should be well prepared. Hope for the best, prepare for the worst! Good luck.

If your individual processing time/day count exceeds the current CIC processing time of WP, please take the initiative to seek help from your Member of Parliament (MP) within your constituency (or residential area). Gather all evidence including your application number and let your MP know about your situation. 5. If you paid only $155 and never paid the extra $100 for all OWP holders, please visit these two sites to pay and upload the remaining balance (receipt):
a) Online Payment at: https://eservices.cic.gc.ca/epay/welcome.do?lang=en. Once you are there follow the instructions below:
Click continue below > Accept disclaimer > Immigration > Temporary residence > Open work permit holder fee > type 1 for number of
applications > Submit > Pay. You will be asked to register on the online payment system in case you are not.

b) Case Specific Enquiry (CSE) at: https://secure.cic.gc.ca/enquiries-renseignements/canada-case-cas-eng.aspx?_ga=1.63908399.108801500.1431902909
Use this online form to upload the PDF receipt you received. First fill in your UCI, address, phone etc. Scan and upload it to the CSE.
Also, type a short precise message (in the message box) indicating your reasons. In that message don't forget to include your online
Application Number that begins with a W.

6. ** New TRV for those who want to travel after receiving their PGWP. Processing fee is $100 (the required docs for application include; passport copy, face/head photograph, IMM5257E form, and a copy of your PGWP). Please be aware that your PGWP doesn't give you the right to return to Canada. You need a new TRV that you apply for as a worker NOT as a student. 7. Unless its a family emergency, please make your travel plans carefully and wisely.

Hi all!

Pls count me in: applied on July 18, asked for urgent processing on September 18 because of the unusual situation. On Sep 30 received the notification that my request for urgent processing was received. Still waiting.

Angela, you will not get your PGWP at the border because your study permit has already expired. An officer even with all the sympathy will be forced to reject your request because it is no longer valid. PGWP application works only while respective SP is valid, i.e. not expired. I experienced this situation on Sep 12. I had very unusual case that brought a lot of sympathy, they even called superintendent and requested additional clarifications from other CBSA offices.

I don't know if a permit "for an accompanying spouse" works. Probably yes?

Regarding the TRV. I think it is quite risky but don't know how much.

I think the most probable scenario is that they will tell you get out of there. They probably will not want to deport you (why all the struggle) but may not be in the position to issue a permit because you technically will not be able to cross the border without a TRV. If I were you, I would ask a lawyer about the latter.
