Hi, after more research on this forum I have a question about leaving the country while on a WHV. My girlfriend and I are considering getting married in the very near future. She is from Germany and on a WHV that runs out at the end of Feb. If we get married now and I apply to sponsor her in about 7 weeks, would she be allowed to fly home for Christmas and return? I know you are not supposed to do that if you just have an inland sponsorship application in, but since she would still have her WHV (while the application for inland sponsorship is in process) could she show that and explain that she's entering to use the remaning time on it? Other than just re-entering the country would this come up later in the sponsorship? Thanks for your help.
 
Because she is from Germany she does not need a visa to enter Canada, so she would probably be let back in. It is not that the government won't let inland applicants out, it is that if they leave Canada and are not let back in, the inland application is over.
Probably she would be let back in, but it is always a risk.
 
Everyone that we've talked to said that if she was just on her WHV and she left for a few weeks then returned she should have no problem re-entering the country as long as she has time left on her WHV. How would having an inland application make it more risky if normally with just a WHV it would be no problem? Thanks for the help.

The only risk is if for some weird reason she gets denied at re-entry into Canada. Then the inland sponsorship would be cancelled. Again it would have to be a weird reason since she is normally allowed in without problem.
 
The risk is in the "Dual Intent". Just because she has an app in progress, that does not mean she is excluded from satisfying the visitor requirements. So, if you get an asshole officer, they could deny her as a risk for living in Canada and not leaving. But, in most cases from people from visa-exempt countries, the worst thing that happens is they get stuck with a visitor record. Just make sure she still brings proof like any other visitor, that she has ties to Germany, money in the bank to support herself, and a return ticket.

Now, how the CIC looks at leaving the country while applying inland, that I don't know.
 
So it all comes down to the officer then? I just didn't think it would really come up.
Alright, some people say it would matter for the inland sponsorship process if she left while others think it would not be a big deal?

Yes - it's entirely up to the officer.

Here's the summary of what you are facing:
- If she leaves, she will most likely be allowed back in.
- Having said that, there is no guarantee she will be allowed back in and there's nothing you can do to guarantee she will be allowed back in.
- If she is not allowed back in, this will effectively cancel the inland application and you'll have to start the application process from scratch using outland.

And yes - we have seen a handful of examples here over the years where someone in her situation wasn't allowed to re-enter Canada. It doesn't happen very often. But it does happen. Again, entirely up to the officer.
 
Ok aside from them possibly not leting her back into the country when she returns is there anyting else that could come up? When they made a mistake on her WP when she first arrived we applied to have it fixed. They asked for all stamped pages of her passport to be scanned. Would her stamps from re-entering Canada be an issue for the inland sponsorhsip, would they even ask for that? Thanks a lot for the replies. This is helping to shape our decision.
 
The stamps from reentering won't matter.
