Hi,

I have landed to Canada in January on family sponsorship but i came back to my home country in February 2016 without getting my PR card. During my stay in my home country (outside Canada), my sister in Canada received the letter from CIC stating that my request for PR card was not approved because of the improper photographic specisfications. So, i resend my photographs to them from my home country as per their requirement. I havent received any response regarding PR card yet since 15th April 2016.

Now, my wedding will be in august 2016 outside canada. My questions are

1) Since i do not have PR card, after getting married outside canada if i apply for travel document, then will my relationship status can affect my travel document visa issuance??

2) If i get married , can they reject my PR status since i do not have PR card yet (i only have the landed immigrant document and stamp on my passport showing that i have landed in their country) ??

Was it in Jan 2016 your first landing. Did you give your canadian mailing address to cic ?.If so your PR card would be mailed to the address given by you.That might have been delivered already. If you didnt provide any

If you are a new permanent resident, you do not need to apply for a permanent resident card. One will be sent to you automatically. If you did not provide your Canadian mailing address when you became a permanent resident, you must send it using our online tool within 180 days of immigrating. If you do not, your card will be destroyed and you must apply for a new one and pay the $50 processing fee.

Yes my landing was in January 2016 and i gave them my sister Canadian mailing address. However, my sister has not received my PR card.

1. Yes, but the requirement for those without a PR Card to use an eTA, has been delayed until September. You may be able to return to Canada without one, if you have a visa-exempt passport.

2. No. You are a PR, even without the PR Card. Just show your COPR and passport when you encounter the CBSA officer when you re-enter Canada.

It's not CBSA that needs to see the PR Card...it's (usually) the airline, or other commercial carrier, that needs to see it IF THEY KNOW, OR SUSPECT that you are a PR of Canada.

But my home country is Pakistan so i do not have visa exempt passport. But i have US visit visa multiple entry so can i travel by private vehicle without PR card and only on COPR?

Secondly, how long can i stay outside Canada on COPR document? are the rules same (three out of five years??)

Yes, you can stay outside Canada for up to 3 years. However, keep in mind that if you did not apply for a SIN after your landing, you should do so now through the mail because you can only get SIN with a COPR that is less than 1 years old. If you arrive in Canada more than one year after your landing and need to apply for a SIN in order to be able to work, they will no longer accept the COPR but ask for a PR card. If you are applying for a PR card more than 6 months after your landing, it will no longer be treated as a new PR card but as a renewal which means the processing times are longer. Currently it's only 80 days but it can vary and sometimes has been as long as 9 months.

Thank you for your reply. I have SIN with me already alongwih COPR but the only thing I don't have Is the PR card. I am worried because I am going to be married in August in Pakistan and after a year I will go to Canada again and work there. I am still waiting for the PR card to be mailed at my sister house. It's been 70 days since I sent them the photographs they wanted for my PR card. So, is it ok if I go after marriage one year later?

out of 60 months you will be staying 20 mon approx out of canada .In remaining 40 months should be enough for fulfilling RO but spouse from pakistan may take longer time
