Korean Police Certificate -- ILLEGAL document

I am having the same difficulties getting the police certificate. I went to the embassy in London to get the police certificate with lapsed records and they said that they are not allowed to issue this certificate as this is only possible to obtain from within Korea and even then it's only for personal use so it may be difficult to obtain. So they will issue just the "Background Check (Criminal Records) Certificate".... I will submit this with a LoE explaining the situation and hopefully, the application will go through smoothly.
Please consider getting some documentation in writing in addition to your LoE. People who have been successful have submitted emails from the Canadian Embassy in Korea, Korean Consulate in Toronto, and Korean National Police as supporting documents. Obtained Korean PCC via askkorealaw.com, fees 300USD per person. I got the PCC on signing a form that it will be for personal verification only. Also, obtained a legal document stating the articles that makes it illegal to submit to any 3rd party. Fees for legal document, 250 USD.

Please consider getting some documentation in writing in addition to your LoE. People who have been successful have submitted emails from the Canadian Embassy in Korea, Korean Consulate in Toronto, and Korean National Police as supporting documents. Here are the email addresses so you can get those:

I have managed to request the document from another Lawyer a bit cheaper from askkorealaw and they told me the following that, under Korean law, it is illegal to use the Reply with lapsed sentences, for any purposes other than for personal verification purpose. Requesting the Reply for personal purpose is the only way to retrieve this Reply with lapsed sentences.

They said that while it is common practice among foreign(non-Korean) governments to request these Replies with lapsed sentences for immigration purposes, and applicants usually comply with such request, it is illegal for foreign governments to require this Reply with lapsed sentences(They are only allowed to request and receive Replies without lapsed sentences). Risk of actual prosecution of this ‘illegal action’ by foreign governments or you is extremely low(virtually nonexistent), this document is for personal use only, and sharing this Reply with anyone else is forbidden.

Today I got my landing letter - PR approved a week ago.

I submitted the free Criminal Record Check that I got from my local Korean Consulate (in Vancouver).

I also submitted emails from the Korean Police Agency, the Korean Foreign Office, the Korean consulate in Toronto - all stating that the document requested was no longer being issued by the Korean Police Agency. I also submitted emails forwarded to me from other people on this forum and elsewhere who had been officially informed that the document was no longer available. Thank you to all those who helped me in this way.

I am happy to forward any of the emails I received from official sources. It may make a difference that I am NOT KOREAN and do not live in Korea. Still, if I can help anyone through this bit of dodgy legislation, I will.

I didn't want to do it with askKorealaw.com because I couldn't find any reliable sources of information that said that they would indeed provide the certificate so I looked at the UK government foreign office (https://www.gov.uk/government/publications/south-korea-list-of-lawyers) for south korea. In it is the contact of the law firm called Sijoong (www.sijoong.com), which is the one I used.

Yes, you are correct! I also have been to many police stations such as the central police station in Korea. None of them can provide a criminal report with lapsed sentences since it is illegal. It is mentioned in exact articles saying it is illegal in the paper. see below. updated by 2020-08-13 actual criminal report

"This reply can be used for permission of foreign country immigration and stay purpose only. Person who use the reply for other purposes will be sentenced to imprisonment for not more than 2 years of a fine not exceeding 20 million won, in accordance with the second and the third clause of Article 10 in 'ACT ON THE LAPSE OF CRIMINAL SENTENCES'

Any Korean applicants here? My husband is trying to get the criminal record check with 실효된 형 포함 (lapsed records). In Korea, it is illegal to obtain this file. They will not release this information. My husband's brother has been to 2 different police stations and they will not release this file. What do we do?strugglingYes it is Ture. I summited with what they provided with my application. Since threre is sentence saying that it is illegal by Korean law they might reconsider it wait and see
That's good to know you managed to get the correct PCC. I wonder how your husband's mom did to get this version ? I'm sure many would like to know how,

Did anyone get an update from CIC/IRCC with their gathered evidence for not being able to get the specific "illegal "document - Criminal (Investigation) Records Check Reply (범죄· 수사경력 회보서).

Also if any local Korean is able to accompany me to a police station where they received it - Ill be really grateful :(

I tried many police stations too. nowhere can provide paper like this. I just summited with the police station provided. If you have any updates please share.

Hi, if you haven't already done so, I recommend emailing the following about the situation:

I emailed all of them. It only took about 2 days for each of them to respond.

The Korean consulate and national police both said that the document is illegal to obtain. The Canadian embassy suggested that I submit the document provided without the lapsed records, along with any "supporting documents." I simply printed out all three of these emails and included them in my application, along with my own one page cover letter explaining the situation. I still haven't heard back on my application yet (I'm a September applicant), but based on what others have said here, I think this will be enough to satisfy the officer. When you can't provide what they are asking for, it's good to provide as much proof as possible as to why.
