Korean Police Certificate -- ILLEGAL document

Any Korean applicants here? My husband is trying to get the criminal record check with 실효된 형 포함 (lapsed records). In Korea, it is illegal to obtain this file. They will not release this information. My husband's brother has been to 2 different police stations and they will not release this file. What do we do??

I am no familiar with Korean laws but i know CIC can provide you a form where they explain that you need the certificates for immigration purposes, it s all in the country specific section of the police certificates page

Yes, that's right but in Korea, there is 2 kind of police certificate. The first one is one produced with Purpose of referencement : For immigration purpose, which is easy to get but IRCC require a police certificate with Purpose of referencement : For confirmation of investigation case materials (including lapsed of criminal sentences) and this one is illegal to get now.

I don't know if printing the IRCC form, filling it and showing at a police clerk with a form with the correct cases checked (never check the case for immigration purpose, check the two cases below it) would work. If not, there is a big problem indeed. We didn't print it but still got the correct police certificate after a lot of discussion and begging between my brother-in-law and the police clerk.

I worked in seoul for 2 years, which requires me to get a police clearance. I am now outside of seoul. I got the police clearance through korean embassy. That is what i sent to cic with a letter of explanation.

(e.g. embassy will only issue the standard police clearance.)

Fingers crossed that they accept these, otherwise i am *****!!!! Hehehehe.

What did you write in the letter of explanation ?

To be honest, by reading lots of posts about that, they will surely reject the police certificate from the embassy because they cannot produce the correct one with lapsed records. Those will have to be from a police station in Korea and in your situation, it's a bit tricky indeed.

We were still thinking of a solution when i came across your post? Were you able to resolve this? how?

We were still thinking of a solution when i came across your post? Were you able to resolve this? how?
Did they explain the reason behind this change ? If it become a real issue, IRCC need to know this and find alternative ways.

How can we make it known to ircc? Typical Korea, policies are not explained, foreigners can go to hell if they don't like it.

I also wonder about how to notify IRCC about that... If I know how, I would have reported this issue for others (not a issue for us as we still managed to get the correct PCC after a lot of begging).

I got it on may 25th 2018 in Busan before we returned to Canada but I can understand the problem because it's indeed complicated to get it "legally" (the police clerk told us her job is at stake for allowing this).
I read somewhere else that you applied as a Korean, you may have a chance with that, as a foreigner it's becoming a clueless situation. I Read tgatwe could get it through allminwon for $80, that's the next step now

Yes, that’s my korean wife but it’s still hard to get as it seems forbidden for anyone. We didn’t catch what is required to get it...

My husband's mom was able to get it for us 2 weeks ago. We originally submitted the "legal" one upfront with the application, but received a request to submit one with lapsed records on 8/8, so I think IRCC still doesn't allow the other type.

By the way, can we form a whatspp group for Korean applicants? I can barely find any Korean applicants in this forum to discuss about application status with.
