Good morning JamFam,

I hope the day is going well for each an everyone of you so far.

Well, I am on my 87 day of waiting to hear whether my Sponsor was approved. I have read in another forum of a similar case as my own an it was refused...I am aslo reading on cic tht I would have 30 day in which it appeal my case if it was refused. I jus cant figure what could they be processing so long. At this point, I honestly thing they are weighing whether or not I Misrepresented on my VISA application by putting single.

But in all honestly this case is very very technical ...but the wait is jus scaring me

I have a few questions for you guys,

1. If he has his own "family" household where he resided and I have my own, and he visited on a regular that could nt be seen as a common-law relationship could it?

2. a) If it can not be classified as a common-law relationship given it does not have all the characteristics to hold claim to it, would that then mean we where only dating?
b) And if so can they still argue Misrepresentation under tht clause?

3. Given that we were only dating and not common law nor conjugal would that mean I am or was at the time in fact single?

4. If all documents provided are dated in 2013 when the sponsor arrived in canada (ie bank account started 2013, life insurance 2013 western union 2013 everything dated after his arrived in canada) couldn't that mean the proof of conjugal relationship began in 2013 to present.

could you guys give me your honest review... I know even though we provide our evidence the review is subjective because no one is there speak on them an thus it can only be judge by what was provided so be subject let me know.

P.S. I know Im rambling but im honestly scared and lost right now.
Thank you guys

The sponsorship approval has nothing to do with you but with your boyfriend....and yes he can be declined if there was misrepresented....which a few of us have stated as he didn't claim you when he landed and you have now applied for family class under conjugal saying that you did live together....so unless this information that you said isn't true then don't worry about it and let them work on the file. There have been a few people on here that have waited long for SA...but again he can only be declined if he doesn't meet the requirments for SA or has misresprented himself.

1) you have to live in the same household for more than 365 days to be common law....again conjugal doean't apply to you as you have been together and there are no reasons stopping you from being married IE - regilous reasons

2) Yes you are dating but you have stated in the past that you did live together so i am no confused.

3) If you are not common law then yes you are considered dating only and therefore you can't apply for your PR. You have to be in a common law relationship or married. You are not conjugal as I have stated before. There is nothing holding you guys apart except the fact the hs is in Canada and you are in JA. That is not an issue at all.

4) Read above

Roxie...I M sorry if I sound harsh but you have been asking the same questions over and over again and have been told by me and other very senior members on this forum the same thing. I am giving you my honest answer. You are better off cancelling your file, getting married and then applyng again. You will be declined for conjugal and you don't apply for common law - and if you did apply for common law you boyfriend misrepressented himself when he landed and he can have his PR taken away and he will have to leave Canada.

I just receieve that email from POS :

Dear Sir/Madam,

This is in response to your recent enquiry to the Immigration Section of the High Commission of Canada in Port of Spain.

Please note your file is not at this office. Please direct your query to the Immigration Section of the High Commission of Canada in Kingston, Jamaica.

We trust that this information will be of assistance.

And they confirmed to me on Sept 5 that it was there :

Dear Sir/Madam,

This is in response to your recent enquiry to the Immigration Section of the High Commission of Canada in Port of Spain.

This Family Class application was received by our office after being forwarded by Case Processing Centre Mississauga. This application is currently pending initial review, after which we will contact the applicant directly to advise the outcome of the review and any next steps.

NOW Im totally confused !!!!!!!!

WOW....they really don't know what they are doing. I would call CIC and let them know that you have been told two different things and see where you're file really is.

Call CIC mississauga...they will be able to confirm exactly where your file is. it is much easier for us to deal with our own than to get a response from kingston or pos. they may not be able to give you any info on your file as to why its still pending initial review but i would think they can tell you exactly which office your file sits in. that is absolutely ridiculous on their behalf. as if this process isnt hard enough without them confusing us! hang in there lady, just call and see what they say.

sometimes i feel like some of us get different info than others...all from the same office!!! its F'n annoying!

regardless your process is nearing its end and im glad to hear it.

Jah-Canadian said:
yes the fees that you can as did i...but that fee cannot be paid until requested by them...and is one of the final steps before requesting passport....as per CIC immigration, because i thought i had paid all fees as well and they confirmed that that was impossible... a landing fee request does not happen until the in process point.

My bad Jamwife, i was just sharing the info i was given yesterday by CIC, but i would hate to discourage or upset anyone...i stand corrected.

Well...got our notes today and they started working on our file July 30th!! They have no concerns over our relationship or anything. Criminal or Security haven't been started yet though but they may have been as these notes were done in August. Our new bring forward date is September 30th.

Also there was a little note there to my MP..I guess they checked up on my file and I didn't know. My MP never emailed me to tel me anything. In the beginning of July they (Kingston) said they were working on file from Jan-Mar 2013.....however by the end of the month they are working on June files!!! Shows how they work there...all over the place.

Sammmy Thats another questions I had to ask you......do u think i should apply for my notes aswell and if so do i apply separately for sponsorship then for permanent residents card? or is it immigration file : permanent resident?
