Happy New Year to all! and Wish Everyone All the BEST! have not been on here for some time. I have a pending question on my mind. if my husband has only been in Canada for less than 3 years can I sponsor his daughter who is 14 yrs of age in Jamaica to come up? he is a PR so I am not sure how to go about this? I told him I'd rather wait until he has a permanent full time job, as I feel he is trying to put pressure on me as his daughter is not mine and I have a dependant and I am the primary income holder and he does not even have a full time job only 2 part time. One is with an agency and the other he is on probation until the end of this month ??? ??? ???
what do you think? I need some answers???

What is the main problem you are having? Is it having to sponsor his daughter and then being responsible for her another 10yrs if she goes on welfare etc, or is it having the burden of another mouth to feed when things are already tight? If your problem is not wanting to be responsible then your husband can sponsor her himself, he does'nt need to be a citizen to do so. There is no minimum income required, you dont even need to cosign, but you guys will have to come up with the $1040 application fees, but out of that only $550 is required right away. If the problem is the addtional mouth to feed then you've got me there. It must be important to your spouse for his child to be there, you need to let your husband know your concerns and work from there. It is obvious that he is not lazy as he has 2 jobs, maybe he can get training to get into a more stable field of work. The daughter is not so young as to cause a severe burden, she should be able to get a part time job in Canada like a lot of high school students do. The probationary job could turn into a fulltime one. I understand your reluctance, but try to consider how you would feel being separated from your child. If he is willing to do the work (sponser her himself) then you should support him, after all that is what relationships are about.

thanks Trini I am willing to help get her here, but I went onto the Government Sponsor site and it clearly states You may NOT sponsor if you...
  • signed an undertaking for a previous case (husband) and 3 years have no elapsed since he or she became a permanent resident

    so, as it appears we will have to wait another couple of years, after all we have time. Or am i incorrect?

Yes you have untill she before she turns 22. Even though you cant sponsor his daughter, he can. He did not sign the undertaking, you did.

Angella - You cannot sponsor your stepchild directly, there is no provision for that. Your HUSBAND must apply to sponsor her as his dependent, and as his income alone probably does not cover the LICO for a family of 4 (you, him, your child and his daughter) then he will need a co-signer, which would be you, as his spouse, because although he does not need a specific income to sponsor her, his income will be measured against the needs of all the persons in the family, including the three of you and her. By the way, the fees would not be $1,040, that is for a spouse. A principal applicant who is a child under 22 is $640 ($75 for sponsor + $75 for principal applicant + $490 for RPRF). The LICO for a family of 4 was $41,307 up to Dec last year.

LHNB - welcome back to the cold, LOL. It's nice and breezy here in Jamaica these last couple days, LOL. I am making resolutions this year, I have not done so for a couple years now, but I figured 2012 sounded like a resolution-type year. :p

Does anyone think it would be a issue of my husband not puting my son on the application as his stepson. I'm sponsoring my husband from Jamaica to canada. He doesn't have any kids. Just my son, but it wasn't mentioned on his part of the application?

Did you all hear about the "conditional visa" in the family class-spouse category that canadian immigration minister would like to impose this year? Basically, in an attempt to "weed out" fake marriages there would be a stipulation that couples would have to stay together for 2 years (not sure if this is in addition to the 3 years sponsor is already responsible for spouse) and if it happens that you file for divorce, the sponsored person cannot file for a "new spouse" for 5 years. The opposing argument is that immigration should work on improving their screening process instead of trying to force people to stay together in marriages (if valid) that are just not working anymore. They say this is in response to a lot of "fake marriages" emerging from India and China. (people using photo shop to manipulate wedding pics etc.)
