Hi all.....if anyone can help please feel free.

I started work for this company in April 2009. This is what they have said:

I am not satisfied that you meet the skilled work experience requirements because your application does not contain the information as set out in the document checklist to demonstrate 24 months of full-time work experience in this position. Specifically, you submitted a confirmation of employment and a reference letter issued on May 31, 2011. For this reason, I am satisfied you acquired work experience from July 12, 2009 (eligibility period start date) until May 31, 2011, which is less than the minimum 2 years of work experience required to qualify under the Temporary Foreign Worker Stream.

Few Questions: your NOC code and your timelines please?
Also, did you submit a recent employer reference letter with your application?

Can you provide some more info, please? Do you know why the letter says that the start of your eligibility period is in July even though you started in April?

Is it possible that part of your work experience was not counted because it happened more than 3 years before you applied?
 
Hi,

My NOC code is 7261 (7291 under 2011 classification)- Roofer.
My application was sent back twice due to various problems with paperwork (although i was assured by an 'expert' that it was good to go)
It finally got considered complete in August 2012.

Yes, we need some clarity on your situation. Also, the eligibility criteria is lowered from 2 to 1 year now under NOC 0, A and B.

Please give us more information.

Based on the paperwork you submitted, can you interpret the reasons why the visa officer is counting your experience from July 12, 2009 and not April 2009?
 
Oh Shoot, something tells me that ur application was either assessed as a FSW
OR
The rule the officer used to assess u under CEC was the old rule of 2 years work ex
 
I think this might be part of the problem:

"For the Temporary Foreign Worker Stream, the applicant must have 24 months of fulltime equivalent Canadian skilled-work experience at NOC 0, A or B acquired in Canada,
within the 36 months preceding the date their application is made" (from OP-25)

When was your application received by CIC?
 
How are you able to say that the application was considered complete in August 2012? Is that the application received date which you see online in ECAS?

July can also be the 3 month probation period you must've passed before being confirmed as a full time permanent employee.
But that's not the issue, the issue is why would they assess u based on the old CEC rule.
2 things u can do, 1) call CIC first thing tomorrow and tell them that u have been asses based on rule 1 and ask if u can resend ur application under rule 2
2) Catch ur lawyer/consultants neck and take ur money back
 
Not if your application was received in July... In that case, part of your work experience wouldn't count anymore because it's past 3 years...

Winterfox, there is no way an applicant filing his application in Aug 2012 can be assessed under new rules effective Jan 2, 2013. CIC will never do that.
I suggest not to waste anymore time and send an email to CIC with all kinds of documentation which you can provide to prove your 2yrs experience and wait for a reply for a week. Else, re-apply (I really hate to use this word "re-apply) :(
 
U can reapply before 31 may 2013. They will consider ur experience between 31 may 2010 to 31 may 2011. Its one year experience in last 3 years for you.
