I am the guy waiting from 4 months. Haven’t heard a word about reopening the application, haven’t received any correspondence. I received settlement after receiving rule 9, my case (inland spousal sponsorship) had a huge error in the law. I received procedural fairness for genuineness of relationship. After that I removed my consultant and responded with solid bulk evidence and but still was refused a month later. I filed for JR with one of the lawyers in Toronto.
After receiving rule 9, it was quite evident that the immigration officer who rendered the refusal didn’t bother looking at my submitted response which was in bulk. I got settlement by IRCC on October 18th 2021. My lawyer filed discontinuous after 2-3 days I guess.
I am still waiting to hear back… The immigration office is Etobicoke local office which is known for its delays and carelessness. Please if anybody know how much longer do I have to wait, please let me know or anything I can do to expedite the procedure. I am bugging my lawyer from 2 weeks now to follow with department of justice but he is saying when the case was settled the Ircc lawyer who gave settlement mentioned to expect a significant delay in processing of the application. I no longer see my application in ecas tool since they remove the application from there after 6 months of refusal. I haven’t met my parents back home from 8 years. I’m devastated to think that I have not been able to attend few family funerals as well. I have missed a lot of things because of error in Canadian immigration.
What kept you from visiting your home country for 8 years?

I wish you all the best with your JR . But my honest opinion is just apply from your home country (question 7 and 9 ) on the IMM form. No matter what you do the VO will accord less weight to UAE ties unless you have citizenship. You can even be a CEO . it doesnt matter !! I have been following your posts for a very longtime and each time you where preparing to reapply i honestly knew you where going to get the same response.
A lot of people from the middle east get approved as well. It's not like everyone will be refused, it's just that when they have to refuse someone they add multiple reasons including temporary status to make their decision strong.

Agreed but we know it depends on your profile. if you are fresh graduate from high school here in UAE your chances will be better than a worker trying to show ties to UAE.. A country that currently doesn't give citizenship . The VO knows that once you loose your job for any reason you have to find another or go back to your home country , so why will the VO accord more weight to your ties if you are ‘temporal’. However if I am a fresh graduate from high school and my parents are workers here i will have much stronger ties …in short , its better as a worker seeking a student permit to try to show ties to home country and not UAE

Yes next application would be from home country i waiting for offer letter from 2 universities if i get i will apply from Pakistan. But please advise what to write in sop or forms as i currently working in Dubai as Engineer and if i go back to Pakistan question 7 and 9 in forms. I know many people got success especially philpines those who did that but its confusing how VO officer didnt know that these guys previously refused from UAE and now applying from philpine and he issuing visas

Question 9 only determines the country where application will be processed by answering yes or no . I understand that by choosing Pakistan it will still come to Abu dhabi office but since you have stated in question 7 that you are a pakistani citizen then it shouldn't be a problem and more weight will be accorded to your ties to home country. See it this way, as a VO this how I think ; in case you get into any trouble ( God forbid )in Canada and have to be deported, will you be deported to UAE or Pakistan ? In your SOP (assuming they are not using chinook) talk about employment prospects, property, family ties relating to Pakistan. if possible also get a provisional job offer letter from Pakistan and explain in SOP . Every application is treated on its own merit so dont worry about previous refusals

Since Chinook is an AI tool and I don't think it would have the capability to go through the supporting documents since most of them are not text searchable. The most Chinook could do is analyze the form which is machine-readable already and give its summary to the VO. The VO can then choose to refuse on the basis of that analysis by Chinook or go through supporting documents manually.

Agreed so why dont we beat chinook by answering the right questions correctly? look at this simple code ; if country of residence/home country =UAE and country of application is same as country of residence/home country(UAE) and applicant also not UAE national then accord less weight and flag for possible refusal. Depending on VO load of applicants they will just go with chinook to save time

Yes, keep country of residence and country of citizenship same, do medical from home country. People can do remote jobs so showing a job in the UAE won't mean that the person resides in UAE. Stay in your home country for a month before applying.

Medicals are valid for 1 year so it doesnt really matter where its done as long as its valid it can be done from any country. You dont actually also need to be in your home country before you apply since everything is online based . Just be ready to receive the PPR from the home country when its approved

No aspirant is right. Everything is possible but yes its a happier moment because i had believe i can't go canada after 3 refusal and was working on UK plan. But with settlement i got a hope of visa but also its look dream because getting settlement from UAE and abu dhabi office its hard. This office force applicant to go for JR and waste time arround year and more. Its something good news for me and also those victims from abu dhabi office that with JR keep hope of settlement and the reason is they dont study our files and leave everything on chinook software
I know he might be right. But you can’t judge a probarlity if one guy got rejected you will as well. He clearly is not caring about many people who got accepted. He and Canuck are saying things with no proof or justification.
