My initial thought too, your duties are matching 100% with the wording on the website, they may have taken this negatively. :'(

I agree this is a possibility. However, to match the requirements is surely the aim of the exercise. I could have provided a 'War & Peace' style tome about my job description but assumed (wrongly now it seems) that a verified reference to validate the responsibilities required was a more professional and concise way to convey the information.

If it is the case that you have to 'sketch around' the duties and responsibilities it may be a good indication as to what is required for new applicants. In that respect my failed application has at least served a purpose for others.

In my opinion and also supported by the Operation Manual 120, CIC does not want to see the matching of duties - which deemed to be taken verbatim from the website, and we do not have to "sketch around" the main duties listed as well. We have to list a more detailed duties pertaining to the job or specific project or organization. I think the more specific, in CIC point of view,whould show that the job is real. At the same time - it could create more doubt since, many of us may not be able the experience letter for verification that detailed, especially for a job that was performed a few years ago...But who knows?

Ok, I think it is now about the JD exactly matching the one in the NOC.

But they should have asked for more detailed info rather than reject outright.

I agree. Especially if that is supported by legitimate experience letter from employer. They should not rule that it is not possible to have main duties almost match to those of listed in the NOC website.
Kinda unfair, I think.

Very unfortunate. But didn't Summerlong say s/he was consulting an immigration lawyer - then why wasn't the verbatim matching of the JD from the CIC website highlighted by the legal experts as a red signal? weren't they aware of the consequences. They need to be asked some hard questions.

Anyway, Summerlong, please don't lose heart. In my opinion you should appeal against the decision. I think the IO(s) might have just come to a hasty conclusion.

i surely think it was a result of the copy pasting of the job responsibilities from the website.

you should definitely re-apply ! this is ridiculous on part of the CIC to reject such a strong case without seeking clarification!

From what i read on the forum , quite a few people with negligible amount of managerial experience are able to get their way through the Immigration process just by playing around with the job descriptions.

On the other hand, deserving cases like this are getting rejected . The process needs to be a bit more fool proof with respect to experience validation.

All i can say is keep trying and Good luck!

oh boy this is scary...

I have the same case with 10 years IT experience and no BSc Computer diploma - not a single college diploma/certificate :(

  • I have submitted NOC 0213 application to NS last July,
  • got a positive AOR thru e-mail last Sept,
  • submitted full docs to Manila last Nov,
  • AOR letter from Manila last Dec,
  • and my e-cas changed to IN PROCESS last Jan 6.

Could there still be a chance of acceptance? If I'll get a medical request letter, would that mean I'm off the hook?

I hope and pray my latest 3 years managerial experience with 20 direct reports and cisco, microsoft and a couple of security-related certifications can help me with my application.

I'll update this post once I get anything from the Embassy.

I'm praying and literally waiting several feet away from the front door of our office - that the postman will soon deliver the good news.

Well we had until Feb 10th to appeal the decision but have decided against doing so. I have made enquiries with our lawyer about the wording on the application but they are still of the opinion that the wording was correct and a mistake has been made at CIC. They did advise us to appeal but we don't want to spend further large sums of money with no guaranteed outcome.

Our lawyer has sent a letter on our behalf asking for clarification of the decision, given that i satisfy 5 of the 6 criteria.

When i asked about the chances of our case being reconsidered I was told:
'I cannot give you odds, but if the visa officer is reasonable, the decision will be reconsidered. If the visa officer is uncaring, overworked and just doesn't care, he may not even respond'

Have to say i'm not very impressed but maybe that's just sour grapes?

there is a saying in Hindi which roughly translates to "the husk also gets crushed along with the grain".
there seems to be tons of applicants applying for 0213 category irrespective of whether they have managerial experience or not, kinda like what happened with h1b in the us. officers evaluating such cases might be judging too strictly now, and subsequently rejecting some valid cases.

Summerlong is for sure the victim of one of those rare "World's the most strict IO".
I saw no problem with his degrees except the ones that require applicants to have CompSci or related degrees. Apply again immediately after making some minor changes in Duties.
