It appears that things have in fact changed since 2015, where sponsor approval and verification of the genuine relationship was all that was needed for AIP (as shown in that flowchart that I mentioned a few posts back). In any event, movement is good!

Thank you for all your reply. We have not applied for OWP and in my understanding my partner is out of status right now. I'm approved as a sponsor and for his side, he is done with his medicals and biometrics, eligibility is in progress and criminality hasn't started.

Also, from Etobicoke, the application now got transferred to Niagara visa office after we reached out to MP for help. Does anybody of you know if this is a good sign or the visa office has a track record similar to Etobicoke being slow?
The background checks tend to be the longest part of the process and you can expect not to hear anything during the process but after that is completed you are close to DM

He is out of status. Unless you included OWP application with his inland sponsorship application, he doesn't have implied status.

You may want to check or order GCMS note because most of the inland 2020 application would be near approval or decision made.
Hi, just a quick question, so if a person applies for sowp WITH his inland pr spousal application, and its under process, they can stay in canada on a legal status? (implied status)

You can no longer include the OWP application with the Inland Sponsorship application. That changed last September.

The Inland application does NOT extend the person's status in Canada. However, IF the applicant receives the AOR email from IRCC and then submits an OWP, before their status expires, they would then be under Implied Status.

Thank you for your reply. Just wanted to ask for your suggestion in my case. Since for my inland pr application, AOR will take time to come. and only then I can apply for OWP. I came on visitor visa so my 6 months are going to be up soon. Would you recommend applying for visitor record first, and then wait for AOR so I can apply for OWP so that during all this time I maintain my status

Yes, because if you lose your legal status you would not be eligible for the OWP until you reach the AIP stage.

Thanks again for the quick reply. Basically I am just worried if my visitor record is refused (for whatever reason), I will be out of status anyway. Just a quick question again, so out of status people, they still get the OWP right? Even though its after AIP stage. Is it okay, not applying for visitor record in the first place and just wait till I receive my AIP (regardless of out of status) and THEN applying for OWP later on?

My suggestion is to apply to extend your visitor status and enjoy being able to apply for the OWP sooner.

AIP is so close to approval that you may not even get OWP approval before PR. Not much point applying for an OWP at the AIP stage.

oh okay. By AIP, I meant AOR. (didn't know the difference before). But I got your point. Should I apply for visitor record to maintain my status OR just leave it and wait till I get my AOR and then apply for OWP. (assuming I'm worried for visitor record being rejected)

Ok...consider doing this:
Wait until the day before your status expires and then submit the visitor extension online. You will be under Maintained Status while awaiting a decision.
