Is my father-in-law a citizen already?

Hi all, my husband and I have been landed for almost a year now, we are waiting for the ban to be lifted to sponsor my husbands parents, but I've just seen some answers to an old post of mine that has given me hope that my father in law is already a citizen!!!! Plllleeeeaaase Help??????

Ok so basically my F.I.L's mum was a Canadian citizen when she was young, she didn't give this up by renouncing however she lived all of her adult life in England and gave birth to all of her children in England. My father in law was born in 1949 in the uk. But as his mother was a Canadian citizen at this time (although living in the UK) would this mean Tom my F.I.L has automatic citizenship himself?? Would this be classed as first generation born outside of Canada??

This could be the best news I've had if this is the case!!! We can't wait to have them here with us and show them this amazing country!!

Wow quite the question you have posed. From what you have said in your post I would be fairly certain that your Father in Law indeed would qualify for citizenship. You never mentioned your Mother in Law during your post IF you wanted to bring both to Canada but unless I am reading wrong then yes he would qualify :D

"IF" he was a citizen and I repeat the word "IF" then surely he could apply himself to sponsor his wife through the spousal programme and they could be with you sooner. Hopefully 1 of the admins and people more in the know may post but in theory if he is a citizen then he could definitely apply to sponsor his wife.

Good luck and maybe Leon or Syclla can help with this 1 :D

Well fingers crossed for you and in theory it sounds like a perfect plan but there are a few people on here that have a lot more knowledge than me and may advise you differently but from what you have posted your idea sounds like it is a perfect idea to get your Husbands parents and your in-laws to Canada.

Thank you! Also just to let you know my timeline, I applied 31st may 2011 to sponsor my husband to move to Canada and we landed October 31st 2011 through the London office! So best of luck with your application!

Thanks for that it seems like your timeline from last year is identical to mine. Hopefully October 31 is realistic for me fingers crossed again as that is the day my meds run out :D

Yeah they are basically the same! It took what felt like forever to get the letter telling me that they were looking at the application but once that had happened it was all really quick! I paid all of the fees upfront as was told that it was quicker that way, it certainly was smooth! So yep I'll be keeping my fingers crossed for you too!!

From what you are saying, yes, your FIL is most likely a Canadian citizen. If he was issued a Registration of Birth Abroad certificate, he may be able to use this document as proof of citizenship. Otherwise, he would need to apply for Proof of Citizenship - the application is at http://www.cic.gc.ca/english/citizenship/proof.asp.

For him to sponsor your MIL, he would need to prove his intent to move to Canada as part of the application process if they decide to apply while they are still abroad. But this could all be very quick - spousal sponsorship through the UK (assuming that's where they are) has been wrapping up in 6-9months recently :)

Thank you so much! I need him to apply for proof of citizenship...then we will know for sure!! But it all looks pretty posiive!
