They are basic, front-line support. You are exactly right, they are trained only to handle the basic questions (where can I get an application? what does "conditional" mean? etc). To be fair, most organizations work this way (I work for a company where support is set up this way too). I found the call centre somewhat limited in knowledge but always polite.

Why are you mad, as from your previous posts your husband is American, I don't see why he should be out of status? Some situations I could possibly understand but I'm struggling to find a reason for a US citizen to be out of status in Canada without taking some personal responsibility for that happening?

I called a lawyer he also had no idea of this. I am from the UK and have no excuse either but I had to make a choice for my son now it's backfired

This is probably off topic and I'm not trying to open up a Pandoras box here but I guess I get frustrated when I could have quite easily stayed in Canada and worked illegally as I was offered a position with a large chain to work cash in hand, but I decided to go down the proper routes which has taken some time. Then you hear about people being fast tracked to the front of the queue when they are discovered to be out of status while the rest of us have to wait patiently. And what really grinds my gears is people who then blame the Canadian Government for a situation they have made a conscious decision to be in. I understand everyones circumstances influence the choices they make especially when you mention you had to make your choice becuase of family, but you make that decision you have to live with the possible consequences I suppose. Anyway I'm not trying to make a unpleasant time any worse for anyone but it was just my two cents.

While you are not the only person with this view regarding those that are out of status, you must admit that CIC pulling the plug (apparently) on a public policy that's been in place for nearly 10 years (since Feb 2005) without any warning, is potentially devastating news.

Yes it is indeed bad luck, I'm just hoping that they will still process the applications before they change their guidelines, and that was Oct. 25,2014. I think they always have a lock-in date if, they change their policies. One of the best example I can think of is the dependent age( they have a lock-in date) for applications received on or After August 1,2014, dependent should be less than 19yrs of age. I hope I'm right with my assumption.

Well...since the Guide was updated to now say "...those who wish to apply must have legal immigration status...", to me, says that your application would be denied without status.

You mentioned that you called a lawyer and s/he didn't know anything about this change. Did s/he say that they would look into it?

You should apply in London Visa Office, they are ver quick. I would say 6-8 months, you can go back to UK and come back here as a PR.

To add to the confusion, CIC did NOT change this (instructions in the updated Guide for question 10 on form IMM 0008)

For out-of-status applicants:

Under “Status” select “Other”;
Under “Other” type in “Out of status, requires restoration”;
Leave the “From” and “To” boxes blank.


So, should that have been changed to something like:

For out-of-status applicants:
STOP. YOU ARE INELIGIBLE TO APPLY!
(or something similar)?

Carlaganda23 I would love to do that I just can't leave my son. His dad works full time no one to take of him. He is only 4. He has never been a day without me. If I leave Canada I would be afraid they did not let me back in to wait for my PR.

You can stay here in Canada while you submit your application Outland, I read a thread few months ago, the woman went out-of-status and they applied Outland through London Visa Office, they never had an issue. You should look into that, it's quicker.
