If someone has master degree but didn't mention about it when apply for study permit, is it misrepresentation? Is it legal for him to mention about master degree when he applies for PR?

Why didn't he mention it when applying for a study permit?

Unless he has a PhD, he won't get points for it if he doesn't claim it. In any sense, when CIC asks for your education history, you should probably mention it.

yes, you're right about that.
Humble request to everyone over here, please dont try to bypass the system. Its as simple as that. Certain standards are in place for a reason. When the system requests for details, its not at the discretion of the provider to swallow some and divulge the rest. Be honest and truthful. Good luck.

I have a kind of similar situation. 3 years ago when I applied for my study permit, I did not mention my work experience back in my home country. The work experience was just for one year, not directly relevant to my field of study in Canada and had no access to the documents proving the work experience existed (I was living in the US at that time and not my home country). Now I am planning to apply for my PR and I have gathered all the documents related to that job, proving I did do the job.
I was and am afraid that it would be regarded as misrepresentation with my previous study permit. I have talked to a few people in this forum and they all said it is very improbable that I will be charged with misrepresentation. I called cic today and the agent I talked to assured me that there is no chance of any misrepresentation accusations for my previous study permit. Actually he reiterated it twice. I am also going to talk to a lawyer about this and wil keep you posted. However, another masters for a masters degree study permit is a much more relevant material for the decision rather than one year work experience in a few years ago.
Forum members, could you also please comment on this?

As long as you can prove your work experience you'll be fine. You have already seen what happened to Batman for not mentioning his work experience in his study/work permit and failing to provide additional proof when he received a procedural fairness letter.

What happened to him?! No one has heard anything from him since his last post mentioning he was accused. Furthermore, he had just showed a reference letter for that job, and was asked to provide further documentation, which he failed to do so, and after that he was accused of misrepresentation. I think the accusation had nothing to do with him not mentioning the job in his study permit, as it was just a guess on his side, and not an actual information conveyed by an officer. He failed to provide pay stubs and contract. To be honest I just have these: reference letter, my contract and pay stubs.

Perhaps, but I've seen this exact scenario happen in 2 other occasions. Maybe it is just me who wish that people who fail to disclose information in the first place are held to a higher standard when assessing their work experience. Oh well.

Almost exact situations, both claimed unemployment for specific periods when applying for study/work permits, received a procedural fairness letter asking for pay stubs, tax returns and bank statements. One of them got his PPR after providing the documents, the other I don't think contacted me back so no idea.

That's what scares me. I can't provide tax slips as we don't pay taxes in my home country for the amount I was being paid. I can't have a banks statement as my bank account has been closed for more than 5 years now. I can only provide contract, pay stubs and reference letter. The deal is I am a PhD student and would lose everything in case of a misrepresentation.

You are better off skipping that experience without tax and bank statements as no other documents could prove authenticity like them. Salary slips don't mean much without bank statements.
