Hello there,

So my fiancé had been deported back to mexico from usa and tried to go back to USA twice! (I know he was being dumb lol)
Anyways so first time he tried to re-enter usa was in California....and they just sent him back.
The second time was in Arizona...and he got arrested there for illegal re-entry and was in jail for 4 months.
My question is...is this a criminal charge? will it be considered criminal offense/charge in Canada when we file paperwork??

Given everything that you have said on here and on your other thread, he has illegally entered the US and been charged with a DUI, cut off a house arrest bracelet and fled to Mexico, attempted to illegally re-enter several times and been jailed for several months, been deported from the US.

It is time for you to speak with an experienced immigration lawyer, as you will not get the definite answers that you need from this forum.
 
Better yet you should reconsider your relationship w him seeing as how he so desperately wants to leave Mexico, chances are he is using u to come here. Even if not, his PR application will be difficult because CIC will see he has a history of illegal immigration

I mean seriously? ,Cutting off a bracelet and getting DUI? You would have to be naive if u didnt think he isnt desperately tryin to come here too. If u dont believe me, go tell him you want to live in Mexico and see what he says.
 
in addition to the great advice you have received here. Before you even attempt to apply, obtain his mexican police certificate. You may learn that there may be more more he is so desperately trying to run away from.
 
Not only his Mexican police record, also his FBI and state records to see what US has on him as well. Canada will want his US record as well so you might want to invest in getting a US record to see what you are up against.

This is going to end in tears.. The DUI alone is going to be an issue with CIC. The rest is the icing on the cake.
 
Although it is very personal and your own choice, you must reconsider sponsoring him to canada in the first place like the others on this forum suggested. You must run your own background checks for him.
In my opinion, CIC will find him criminally inadmissible to Canada as they will see his mexican and FBI police records. DUI plus illegal attempts to get into US - your application will be rejected in the initial check itself. Do not waste your money.

Getting caught trying to enter US illegally will not be an icing on the cake. That is a criminal offence that will also show on his US record. So combining that offense along with his DUI will make it rather a big issue.

We had an posting a while back that an applicant got rejected because the spouse broke the conditions of his "driving without insurance" ticket. He was caught driving again without insurance breaking the condition of the first offence. CIC was rejecting him not because he has a record of driving without insurance but wilfully breaking the law by continuing to drive without insurance after getting caught. Thus getting caught again.

Probably a "nicer" idiom than I had really intended. I was trying to imply that it just makes things more "complete" if he is trying to get banned from Canada.

If they love each other, then it will work out, it's really none of our business to say who she / he sponsors here.

Some of what you have all said is accurate though.

If anything, if love truly holds for each other, chances are she will have to move to Mexico and get married there and settle there.

You also seem to forget that Canada and US are now sharing each other immigration records. So it is quite possible that the fiance's immigration record will get flagged if he tried to enter Canada if fiance bypass US. Mexicans still require visas to enter Canada despite NAFTA.

Actually my nick is no relation to that show, even though the character on the show is named Screech.

That aside, I never implied that her fiance was using her. I only gave her realistic expectations to be prepared for if she chooses to go ahead with the sponsorship.

I doubt he wants u to move to Mexico considering he already tried twice to leave Mexico, tried twice to leavr a country that he "wants u to live in"
