Is applying a student visa in order to get married a liability?

Hi,

If someone wants to come to Canada to get married, but they want to circumvent the processing times of an outland application in order to be together as a couple sooner, one idea is to have another kind of visa, like a student visa, and to come into the country like that.

However, if you apply for a student visa and are turned down, and then get married and apply for a spousal visa, will they hold the fact that you applied for a student visa against you?

Has anyone every had experience like this?

People like you make it a lot more difficult for the rest of us.

Play by the rules. If you want to study, get a student visa. If you want to be with you partner, apply as a family member. Can't one of you visit the other to get married? Do you have the $15,000 you'll need to satisfy the financial requirements of a student visa. What happens if you are successful? You arrive in Canada without a genuine desire to study. You get married. Now what? Are you going to apply for your permanent residence? It will be blatantly obvious that you have used the student visa to circument the rules. Delays. Delays. Maybe even rejected permanent resident visa. Now what are you going to do?

With all due respect, play by the rules, and don't be stupid!!

I can understand your question and I don't think it is sneaky as long as you actually plan to study. My fiancee and I are in a similar situation. We would like to get married in Canada and we would like to start our PR application from within Canada (because the Nairobi office has 2+ year processing times). We have been rejected once for a TRV visa and are now considering other options such as student or temporary work. I don't believe this to be not "playing by the rules". The only thing I have heard is that it is more difficult to get either of these visas if we have been rejected for a TRV. :(
