hi i was interviewed on 23 Feb 2014, and just like danish i am also a silent observer of this forum , and my case is just like daish, i was refused straight away by the vo, stating that my NOC 0112 does not match with ur job description, my question is that when cic has approved my case by giving positive eligibility review how come visa officer straight away refused my case, really worried and shocked to see this attitude from VO

You mean NOC 1112? what is you job title? Did VO tell you why you were called for the interview?

Ali I believe I was before the girl's interview or yours interview.
If you are talking about myself. I successfully clear my interview (Alhamdulilah).
At the end of the interview VO told me they will issue me medical very soon.

If you don't mind could you please tell me, how you know the girl get refused?

By the way i am from Lahore Pakistan.

No Mr. Iqbal both of the cases are not on forum ......the girl whom Im talking she is client of a attorney .......and obviously im not talking about you i know you cleared your interview masallah ......Pakistani person who i quoted here is from last year interviews ......

I really feel sorry for you. With the best of my knowledge CIO Sydney will not check your JD and check reference letter's thoroughly. what they are checking this time is IELTS, EDU degree evaluation, rest just from the top not thoroughly.
And when they do file transfer to your local VO they write this in your GCMS "JD's needs to be verified" it is local VO's duty to tailor the JD's and match with your noc and get it verified.

As per my understanding...VO is empowered to accept or reject the candidate...VO is not engaged for the clerical work I suppose...Clause 12 of OP 6-C – Federal Skilled Worker Class[/b] reads:"Visa officers will make a final selection decision for applications that are assessed by the CIO as meeting the pass mark set by the Minister. The visa office will review the application in detail, along with the case analysis provided by the CIO, and will make the final selection decision based on the total points earned by the applicant for the selection factors described in Section 11." also read section 12.2 captioned "Substituted evaluation" ....I am not defending VO...just wana advice people to be rational and not emotional...they are completely aware of the fact that the candidate can file a suite in the court of law...My suggestion would be to wait for the official words as they are required to fully explain the reason behind the rejection...

Yes and I do believe that before making a final decision visa officer again have to review the case and sum up the summary .....making a refusal is tough rather than approval they know if someone wins appeal in court it will added negative point in their profile.......

AK 2147 YOU SAID THE RIGHT WORDS, I HAD OBSERVED THAT CLEARLY VO FROM THE STARTING HAD MADE UP HIS MIND TO REJECT MY APPLICATION , HE WAS IN NO MOOD TO LISTEN TO MY OBSERVATIONS AND CONTINUOUSLY SAID ONE THING THAT I A NOT SATISFIED WITH YOUR JD , AND IT DOES NOT MATCH WITH UR NOC, BUT MY POINT IS THAT IF IT DOES OT MATCH THEN WHY THE HELL CIC APPROVED MY APPLICATION THE FIRST TIME, AS ALL THE DOCUMENTS WERE THE SAME, THIS IS VERY STRANGE AND BIAS ATTITUDE FROM THE VO , AND I HAVE ALREADY EMAILED TO LONDON VO , IN WHICH I TOLD THEM THAT I WAS UNJUSTLY REFUSED BY THE VISA OFFICER

Agreed with Awai's opinion....you should have wait for the official letter...anyway just calm down and wait for their response...I know its very annoying but you have to act smartly and follow the protocols...

In the meanwhile immediately apply for GCMS to see VO notes mentioned in that.

hmm you are right Ali, but u know VO will make the summary when he will go to london visa office and definitely people there will listen to his decision, i know my case is now gone as once VO rejects the case there is little chance of success, really sad and tensed

do not worry i think you are not aware my decision is also pending ........hope for the best ......tell me one thing ....is visa officer state away told you that sorry you have been refused ??????? if not sometime for professional they putt up the candidate in stress and check the reaction .......and the reaction from you with very sorry comes negative if you have done email to LVO .....without knowing decision .......

yes from 1112 , job title financial analyst no vo didnt tell me the reason of the interview but he gave me a negative eligiblity eview stating that my JD does not match with NOC, so in that point he said he is refusing my application,

no he didnt straight away refused he looked at my JD for a while and started questions on my job responsblities , which i explained him all that was in my JD, but in the end he told me that he was not satisfied with ur JD , and just to keep the interest he told me that we will have a detail review on ur application, but it is a negative from my side
