Hello,

I have a question regarding Canadian Permanent Residents who hold European passports or any passports that are eligible under the USA Visa Waiver program. Here is my scenario:

If I go back from Europe to the USA to visit family and I then take a bus to Canada, how do the immigration officers in the USA know that I have not overstayed my 3 months in Canada? Since you normally have to leave Northamerica/Caribbean area for the clock to be reset and being able to enter the USA again? This is something I have tried to find online and I have been unable to find an answer for.

I am worried that next time I fly from Canada to the USA, they are not going to find in their records that I left America. I was going to ask when I landed in the USA the last time, but I totally forgot, plus he did not seem like the friendliest guy anyway.

If you are not coming back to the US you should give them your I-94W at the border. They will enter in the system that you have left the US.

There is no longer an I94 required for people going into the USA under the Visa Waiver program.
It is all done electronically through ESTA so I have nothing to give them when I leave the USA and I am not to sure if they would enter the information if I am just going to Canada.

Very odd, I was issued a physical I94 at the border quite recently.

Correct.
I94 is no more required for VWP [Visa Waiver Program] travellers. It's all electronic now...



Select this option if:
-You are a citizen or eligible national of a Visa Waiver Program country.
-You are currently not in possession of a visitor's visa.
-Your travel is for 90 days or less.
-You plan to travel to the United States for business or pleasure.

I guess that they are still issuing I94's at land borders.
 
Thanks for your comments. However, I would not know what to do at Immigration border in the USA when I come back from Europe and I stop over in Washington to visit my relatives. I just do not want to have any problems when I come back to America just because they think I never left North America and therefore may have overstayed my 3 months in the USA under the visa waiver agreement.

I will try to write to Immigration USA so that they look at this case but I doubt I will get a response.

Check the US website, they have an faq that may help.
