Hello everyone,
I am going to sponsor my wife for PR. Now we are choosing between two ways: inland or Outland. I have couple questions about both.
My wife already has a tourist visa. If we will apply inland and get a work permit, would we be able to leave Canada during the application process, having both valid work permit and visa (let's say go to USA for a week or Mexico for 7 days? Or go back to our home country for couple weeks?)
Her current visa expires in July. If we will choose Outland way can we apply for extension of 1 year (current processing time in our country is 12 months) or is it too much and better apply for 6 months and then apply for another extension again? What are the chances to get that extension in our case?

If you apply Inland, it is generally not recommended to leave Canada at all during the duration of processing (2+ years). It's good that your wife has a visa, but if by any chance she cannot re-enter Canada (I believe a visa does not guarantee that she will be allowed entry - it is up to the discretion of the CBSA officer at the border, and there is a small small possibility that she might come across an officer who got up on the wrong side of his/her bed that day.) her application will be cancelled, because she is no longer in Canada.

If she chooses Outland, she can extend her current visitor status. This is fairly straightforward (it is a good idea to show receipt of payment for the PR fees as proof that she has applied for PR) and it is likely she will get an extension of a year. (I asked for 1 year and got it, I've heard of people getting 2 years. If they give her only 6 months, she can apply again to extend it.)

Since Outland is so much faster, in your place I would apply Outland, to have the freedom to travel freely (if she applies Outland, it doesn't matter where she is, in Canada or outside Canada) and to get PR faster. The Open Work Permit will come only 4 months after applying, so you would only save yourselves a few months.

Thanks for your answer :) we also want to stick with an Outland way. The problem here is how to prove her ties to the home country? She has obviously lost her job already but there are other things that we can mention. Do they need us to prove her ties since she clearly asks CIC to allow her to live in Canada until the decision is made?

She does not need to prove ties back home. If her current status expires before her PR is approved, and she then needs to apply for an extension, you might need to provide some information about ties back home in the extension application. Usually, simply citing that a sponsorship application has been submitted and the applicant is wanting to remain (not live) in Canada, is sufficient for CIC. You/she will likely need to show the financial means to support her visit, in the extension request.

And to clarify...she will NOT be allowed to `live' in Canada until she becomes a PR of Canada. She only has authority to `visit';) you in Canada. She is residing with you in Canada as a visitor.

Okay that's more than clear for me. We will then apply for extension, attach the documents that can prove that I can support her, PR application receipts receipts and a cover letter explaining that we are waiting for PR application to be reviewed and that she wants to reside with me in Canada while the application is in process. Hope that will be enough for them :)

Sure. When I applied for an extension, I attached a cover letter saying that I already applied for PR, and said that in the case my request for extension is denied, I am able and willing go back to my country immediately because I do not want to jeopardize my PR application by staying here illegally.

Good luck!
