Yes, if you land without declaring the new baby, you can never sponsor the baby later. These are CIC's rules. Failing to declare a dependant makes them ineligible for Family Class.

Now, you can spend big money on a lawyer and appeal the case. You will most likely win as babies cannot survive without their parents.... but you have to spend the money! And waste years of your time. Save yourself thousands of dollars and time of appeals and declare the child before landing. It will save you a huge headache too.

If you need to add a baby to your PR application, you need birth certificate, medicals, and the fees for the baby. It takes about 2-3 extra months to process in some cases - but other cases no extra time. (It depends how close you are to getting your visa.) So even if it takes 3 extra months, that's better spending money on a lawyer and waiting for appeals.
Hi Thanks for your clarifications,
I would like to give more clarity on my my question.

If baby is born in CANADA (I am currently residing in CANADA on work permit and my wife is pregnant now and also we did our medicals on Jan 4th 2013, [by then we don't know that she is pregnant]) before passport is stamped and landed, even then need to inform the VO?
for your information - we do have our medicare card from QUEBEC / insurance aswell from my company.

As the baby is born in CANADA, I am assuming baby will become CANADIAN CITIZEN and now the question is why do we need to inform CIO about the new born baby?

Hope my question is clear now.

regards,
...lucky royal.

Yes, child born in Canada is Canadian citizen unless parent(s) are foreign diplomats.

It won't hurt if you inform them by sending copy of birth certificate. Also, IMM0008 says that dependents who are already permanent residents or Canadian citizen shall not be included in Dependants section.

My daughter was born in Quebec. We received CSQ 3 days after she was born by post. I called to MICC to ask whether she needs CSQ. I have been told that she is Canadian and does not need CSQ.
I have sent my daughter birth certificate with my application for PR. In my GCMS, officer added the following note "1 daughter is Canadian born (not added to file). QC B/C for daughter."

You must inform CIC because there is a change in your family structure. Any change in family structure must be report. This is clearly stated on the forms you signed for Immigration. Why exactly you must declare this, I don't know exactly. Either way, you signed a form promising to update CIC if your family structure changed, including additional children. What I do know is if you don't report it and you try to land, you can get in hot water if the IO decides to report you. This can include rejection of your PR visa and banned from Canada. That is an extreme case. It is more likely the IO will tell you to not land, report the child to CIC, and come back once that's done.... but some IOs having a bad day could make for a bad experience if you don't follow the rules. And remember - you signed the forms. You agreed to those rules when you signed.

There is no 'becoming' a Canadian citizen for the baby. The baby IS a citizen automatiacally.

Hi amikety,
I Accept your suggestion, As we are not sure why we must declare, I am planning to consult with lawyers.

Why are you consulting a lawyer? They're going to tell you the same thing I did (hopefully, because if not, they're lying) and charge you money!

hi luckyroyal,

better to be safe than sorry so there is no harm in informing immigration regards the changes in your family structure. i know someone who is already here then got birth before her PR and although the baby is canadian it became a problem to her mother who was here in Canada as she waits for her PR till now it's been more than a year she is fighting her case because apparently immigration told her that she lied and did not update them regards to the change in her family and she will wait for the immigration decison regards her case.

so if I were you its the safest to let them be informed..goodluckl
